Public procurement localisation

On 1 January 2016 enters into force Federal Law No.188-FZ of 29 June 2015. It introduces a registry of domestic software programs. Inclusion of a software programme in the registry will entitle its owner to participation in federal and municipal procurement programs as per Federal Law No. 44-FZ 'On the contracting system in state and municipal procurement of goods, works and services'.

Federal Law No. 44-FZ regulates federal and municipal orders related to the execution of national programmes, other documents with strategic planning content, international treaties and execution of the functions of the state and municipal bodies of the Russian Federation.
Article 14 (3) ofFederal Law 44 FZ has discriminatory content:
'For protection of the bases of the constitutional order, support of the country's defence and national safety, protection of the domestic market of the Russian Federation, development of the national economy, support of the Russian producers by the Government of the Russian Federation, it is prohibited to grant access to goods, works and services, originating from foreign states, respectively performed by foreign persons'...' for the purpose of implementation of procurement'.
