In March 2022, the Brazilian government modified its List of Exceptions to the Common External Tariff (LETEC) to eliminate import duties on certain food products and ethyl alcohol until 31 December 2022.

Import tariff

On 22 March 2022, the Executive Committee of the Brazilian Foreign Trade Chamber (GECEX) issued Resolution No. 317 temporarily eliminating the import duties for certain food products. The modifications were made through an update of the List of Exceptions to the Common External Tariff (LETEC). Resolution Nº 317 was published on 23 March 2022 and will be valid from the day of its publication until 31 December 2022.

In particular, the measure eliminated the import duties on the following products:

  • NCM 0901.21.00 (coffee). The previous value was set at 9% established via Resolution No. 269 of November 2021 (see related state act).
  • NCM 1517.10.00 (margarine). New description created. According to the WTO Tariff Download Facility, the previous value was set at 12%.
  • NCM 0406.10.10 (mozzarella). According to the WTO Tariff Download Facility, the previous value was set at 22%.
  • NCM 1902.19.00 (other pasta). The previous value was set at 14.4% established via Resolution No. 269 of November 2021 (see related state act).
  • NCM 1701.14.00 (other cane sugar). The previous value was set at 14.4% established via Resolution No. 269 of November 2021 (see related state act).
  • NCM 1507.10.00 (other crude oil). New description created. According to the WTO Tariff Download Facility, the previous value was set at 12%.
  • NCM 2207.10.10 (ethyl alcohol). The previous value was set at 18% established via Resolution No. 269 of November 2021 (see related state act).

List of Exceptions to the Common External Tariff
The tariff codes were included in the LETEC of Mercosur. LETEC is a mechanism that allows member states of Mercosur to apply customs duties that are lower or higher than otherwise listed in the Mercosur Common External Tariff schedule. However, the tariffs shall not surpass the ceilings given by the WTO.

Mercosur Decision No. 11/21 gives Brazil the right to maintain a LETEC of 100 NCM codes until 31 December 2028.
