In July 2010, the government of Brazil initiated a sunset review and extended the definitive antidumping duty in July 2011. In July 2017 the duty was again extended for a period of five years, however, it was temporarily suspended pending the conclusion from the department of trade defence.

Anti-dumping

On 19 July 2010, the Brazilian authorities initiated a sunset review of anti-dumping duty imposed on imports of vacuum flasks from China (Circular No. 29, 16.07.2010). The product subject to investigation is classified under the following HS code: 9617.0010. This review follows a petition lodged on 22 April 2010 by Sobral Invicta and M. Agostini (with the support of the company Tritec). The original anti-dumping duty entered into force on July 21, 1999 (Portaria Interministerial MDIC/MF No. 7, 06.07.1999).
 
On 12 July 2011, following the conclusion of the above sunset review the Brazilian authorities extended the anti-dumping duty on imports of vacuum flasks from China (Camex Resolução No. 46, 11.07.2011). The rate of this definitive duty is 47% of the value of the goods for all Chinese exporters. This definitive anti-dumping duty is in force for a period of five years.
 
On 11 July 2016, the Brazilian authorities initiated a sunset review of the above anti-dumping duty on vacuum flasks from China (Circular No. 41, 08.07.2016). This review follows a petition lodged by PMI South America S.A., Sobral Invicta S.A. and Sobral Invicta da Amazônia.

On 7 July 2017, the Brazilian authorities extended the definitive antidumping duty on the subject good from China following the conclusion of the above sunset review (Camex Resolution No. 46 of 2017). The rate of duty remains at 47%. The duty is in force for a period of five years, however, it is suspended due to uncertainties of the likely future development of imports of the subject good. The department of trade defence will in this context prepare reports to determine if the application of duties should be maintained.
