Anti-dumping

On September 2, 2013, the European Commission decided to impose a definitive anti-dumping duty on imports of certain prepared or preserved sweetcorn in kernels originating in Thailand. The rate of the duty ranges from 3.1% to 14.3% depending on the company. This definitive duty has entered into force on September 14, 2013. The products subject to the duty are classified under the following HS codes: ex 2001.9030 and ex 2005.8000.
This duty follows an expiry review requested on March 19, 2012 by the Association Européenne des Transformateurs de Maïs Doux (AETMD) on behalf of producers representing more than 50% of the EU production.
The original anti-dumping investigation was launched by the European Commission on March 28, 2006. The complaint was lodged on February 13, 2006 by the Association Européenne des Transformateurs de Maïs Doux (AETMD) on behalf of producers representing more than 25% of the EU production.
On December 19, 2006 the European Commission decided to impose a provisional anti-dumping duty on the products under investigation. The rate of the duty ranged from 4.3% to 13.2% depending on the company. This provisional duty entered into force on December 21, 2006 for a period of six months.
On June 18, 2007 the European Commission decided to impose a definitive anti-dumping duty on the products under investigation. The rate of the duty ranged from 3.1% to 12.9% depending on the company. This definitive duty entered into force on June 21, 2007.
On September 25, 2008 the European Commission decided to modify the rate of the definitive anti-dumping duty. The rate of the modified duty ranged from 3.1% to 14.3%. This modified definitive anti-dumping duty entered into force on October 1, 2008.
On February 14, 2013, the European Commission initiated a partial interim review of the duty imposed on June 18, 2007 after the Thai exporting company River Kwai International Food Industry Co., Ltd. lodged a request for such a review arguing that circumstances have changed (2013/C42/05, 14.02.2013).

On March 24, 2014, the European authorities terminated the review and decided to modify the rate of the anti-dumping duty imposed on exports of Thai exporting company River Kwai International Food Industry Co., Ltd. from 12.8% to 3.6%. This modification entered into force on the day following the publication of the resolution in the Official Journal of the European Union, i.e. on March 28, 2014.

On 12 September 2018, the European Commission initiated a sunset review on imports of the subject good from Thailand. This follows the request lodged on 13 June 2018 by the Association Auropéenne des Transformateurs de Maïs Doux (AETMD).
