Anti-dumping

On May 31, 2010, the Secretary for Foreign Trade of the Brazilian Ministry of Development, Industry and Foreign Trade decided to initiate an anti-dumping investigation on imports of styrene and butadiene rubber E-SBR 1502 and E-SBR 1712 from South Korea (Circular No. 20, 31.05.2010).
The products subject to investigation are classified under the following HS code: 4002.1919.
The complaint was lodged by Lanxess Elastômeros do Brasil S/A on March 5, 2010.
The investigation started on the day of the publication of the circular in the Federal Official Gazette of Brazil, i.e. on June 1, 2010.

On June 1, 2011, the Brazilian authorities decided to impose a definitive anti-dumping duty on imports of styrene and butadiene rubber E-SBR 1502 and E-SBR 1712 from South Korea (Resolução No. 38, 01.06.2011).
The amount of this definitive duty in USD per tonne ranges from 43.41 to 683.84, depending on the Korean exporter. This definitive anti-dumping duty entered into force on June 2, 2011 for a period of five years.

On September 6, 2011 the Brazilian authorities decided to modify the definitive anti-dumping duty imposed in June 2011 (Resolução No. 60, 06.09.2011). The duty is no longer a fixed amount per tonne (amount depending on the exporter) but becomes a percentage of the value of the good (rate depending on the exporter). The modified definitive anti-dumping duty ranges from 3.0% to 38.8%, depending on the Korean exporter. Those modifications entered into force on September 8, 2011.

On 2 June 2016, the Brazilian authorities terminated the above definitive antidumping duty on imports of the subject good from the Republic of Korea. The duty was terminated as it expired after an application period of five years.
