ANNOUNCEMENT 20 May 2011

In April 2010, the European Commission initiated a new anti-dumping investigation and a definitive duty was imposed in August 2011. The definitive duty was extended to imports of the subject good from Malaysia, India, Indonesia, Thailand and Chinese Taipei following an anti-circumvention investigation. The definitive duty was extended for an additional period in November 2017 following the conclusion of a sunset review.

Anti-dumping

On May 20, 2010 the European Commission initiated an anti-dumping investigation concerning imports of certain open mesh fabrics of glass fibres originating from the People's Republic of China.
The investigation was opened following a complaint made on 6 April 2010 by Saint-Gobain Vertex s.r.o., Tolnatext Fonalfeldolgozo, Valmieras 'Stikla Skiedra' AS and Vitrulan Technical Textiles GmbH on behalf of producers representing more than 25 % of the EU's production of the given product.
The exact specification of the products under investigation is "open mesh fabrics made of glass fibres, with a cell size of more than 1.8mm both in length and in width and weighing more than 35 g/m 2". The products subject to investigation are classified under the following HS codes: ex 7019.4000, ex 7019.5100, ex 7019.5900, ex 7019.9091 and ex 7019.9099.

On February 16, 2011 the European Commission imposed provisional anti-dumping duties on imports of certain open mesh fabrics of glass fibres from China. The rate of the provisional duty ranged from 48.4% to 62.9% depending on the company. It entered into force on February 18, 2011.

On August 3, 2011 the European Commission announced a decision to impose definitive anti-dumping duties on imports of certain open mesh fabrics of glass fibres originating from China. The rate of the definitive duty is identical to the provisional one and ranges from 48.4% to 62.9% depending on the company. It has entered into force on August 10, 2011.

On 16 July 2012 the Council extended the definitive duty in force to imports consigned from Malaysia, see related intervention.
On 10 January 2013 the Council extended the anti-dumping measures in force on imports originating in China, to imports consigned from Chinese Taipei and Thailand, see related intervention.
On 16 December 2013, the Council extended the anti-dumping measures in force on imports originating in China, to imports consigned from India and Indonesia, see related intervention.

On 10 August 2016, the European Commission initiated a sunset review of the anti-dumping duty imposed on imports of certain open mesh fabrics of glass fibres from China (Notice No 2016/C 288/03). This follows the request lodged on 4 May 2016 by the Alliance for the Defence of Open Mesh Fabrics. Since the anti-dumping measure imposed on imports of open mesh fabrics of glass fibres from China was extended to imports of the same products originating in Thailand, Chinese Taipei, Malaysia, India and Indonesia the sunset review and its conclusion will hold for these countries as well.

On 8 November 2017, the European Commission extended the definitive antidumping duty imposed on imports of subject good from China following the conclusion of the above sunset review. The rate of duty is between 48.4% and 62.9% depending on the company. The definitive duty was additionally extended to imports of the same good from Indonesia, India, Malaysia, Thailand and Chinese Taipei, see related interventions.

Anti-circumvention

On December 17, 2013, the European Commission decided to initiate an anti-circumvention investigation on imports of certain slightly modified open mesh fabrics of glass fibres from China (Commission Regulation (EU) No 1356/2013).

This investigation follows suspicion that the definitive anti-dumping duty imposed by Council Implementing Regulation (EU) No 791/2011 dated August 3, 2011 on imports of certain open mesh fabrics of glass fibres from China might be circumvented (see related intervention).
The products subject to investigation are classified under the following HS code: 7019.4000. The products concerned by the possible circumvention are classified under the following HS codes: 7019.5100 and 7019.5900.
The complaint was lodged on November 6, 2013 by Saint-Gobain Adfors CZ s.r.o., Tolnatext Fonalfeldolgozo, Valmieras 'Stikla Skiedra' AS and Vitrulan Technical Textiles GmbH.
Commission Regulation (EU) No 1356/2013 also makes imports of certain slightly modified open mesh fabrics of glass fibres originating in China subject to registration.
On September 15, 2014, the European Commission decided to extend the duty imposed by Council Implementing Regulation (EU) No 791/2011 dated August 3, 2011 on imports of certain open mesh fabrics of glass fibres from China to imports of certain slightly modified open mesh fabrics of glass fibres also originating in China (Commission Implementing Regulation (EU) No 976/2014). The rate of the duty ranges from 48.4% to 62.9% of the net free-at-Union-frontier price, depending on the company. This definitive duty entered into force on September 17, 2014.
Commission Implementing Regulation (EU) No 976/2014 was published in the Official Journal of the European Union (L 274) on September 16, 2014.

On 10 August 2016, the European Commission announced the initiation of a sunset review of the anti-dumping duty imposed on imports of certain open mesh fabrics of glass fibres from China (Notice No 2016/C 288/03). This follows the request lodged on 4 May 2016 by the Alliance for the Defence of Open Mesh Fabrics. Since the anti-dumping measure imposed on imports of open mesh fabrics of glass fibres from China was extended to imports of slightly modified open mesh fabrics of fibre glass from China following an anti-circumvention investigation, the sunset review and its conclusion will hold for this product as well.

This investigation follows suspicion that the definitive anti-dumping duty imposed by Council Implementing Regulation (EU) No 791/2011 on imports of the same product from China might be circumvented (see related intervention). The products subject to investigation are classified under the following HS codes: ex 7019.51.00 and ex 7019.59.00. The complaint was lodged on 10 April 2012 by Saint-Gobain Adfors CZ s.r.o., Tolnatext Fonalfeldolgozo, Valmieras "Stikla Skiedra" AS and Vitrulan Technical Textiles GmbH. This Regulation also makes imports of certain open mesh fabrics of glass fibres from Chinese Taipei and Thailand subject to registration for a period of nine months.

On 17 January 2013, the European Commission extended the anti-dumping measure imposed on imports of certain open mesh fabrics of glass fibres originating in China to imports of the same products originating in Thailand and Chinese Taipei (Council Implementing Regulation (EU) No 21/2013). The rate of the duty is 62.9% of the net free-at-Union-frontier price.

On 10 August 2016, the European Commission announced the initiation of a sunset review of the anti-dumping duty imposed on imports of certain open mesh fabrics of glass fibres from China (Notice No 2016/C 288/03). This follows the request lodged on 4 May 2016 by the Alliance for the Defence of Open Mesh Fabrics. Since the anti-dumping measure imposed on imports of open mesh fabrics of glass fibres from China was extended to imports of the same products originating in Thailand and Chinese Taipei, the sunset review and its conclusion will hold for these countries as well.

The complaint was lodged on 27 September 2011 by Saint-Gobain Adfors CZ s.r.o., Tolnatext Fonalfeldolgozo es Muszakiszovet-gyarto Bt., Valmieras 'Stikla Skiedra' AS and Vitrulan Technical Textiles GmbH. This Regulation also makes imports of certain open mesh fabrics of glass fibres from Malaysia subject to registration for a period of nine months.

On 25 July 2012, the European Commission extended the anti-dumping measure imposed on imports of certain open mesh fabrics of glass fibres originating in China to imports of the same products originating in Malaysia (Council Implementing Regulation (EU)No 672/2012). The rate of the duty is 62.9% of the net free-at-Union-frontier price.

On 10 August 2016, the European Commission announced the initiation of a sunset review of the anti-dumping duty imposed on imports of certain open mesh fabrics of glass fibres from China (Notice No 2016/C 288/03). This follows the request lodged on 4 May 2016 by the Alliance for the Defence of Open Mesh Fabrics. Since the anti-dumping measure imposed on imports of open mesh fabrics of glass fibres from China was extended to imports of the same products originating in Malaysia, the sunset review and its conclusion will hold for this country as well.

Anti-circumvention

On 11 April 2013, the European Commission initiated an anti-circumvention investigation on imports of certain open mesh fabrics of glass fibres from India and Indonesia. (Commission Regulation (EU) No 322/2013). This investigation follows suspicion that the definitive anti-dumping duty imposed by Council Implementing Regulation (EU) No 791/2011 on imports of the same product from China might be circumvented (see related measure 1430). The products subject to investigation are classified under the following HS codes: ex 7019.51.00 and ex 7019.59.00. The complaint was lodged on 25 February 2013 by Saint-Gobain Adfors CZ s.r.o., Tolnatext Fonalfeldolgozo es Muszakiszovet-gyarto Bt., Valmieras 'Stikla Skiedra' AS and Vitrulan Technical Textiles GmbH. This Regulation also makes imports of certain open mesh fabrics of glass fibres from India and Indonesia subject to registration for a period of nine months.

On 21 December 2013, the European Commission extended the anti-dumping measure imposed on imports of certain open mesh fabrics of glass fibres originating in China to imports of the same products originating in India and Indonesia (Council Implementing Regulation (EU) No 1371/2013). The rate of the duty is 62.9% of the net free-at-Union-frontier price. The subject goods produced by the Indian company Montex Glass Fibre Industries Pvt. Ltd. is however exempt from this duty.

On September 23rd, 2014, the European Commission announced the initiation of a partial interim review of the anti-dumping duty imposed on imports of the above-mentioned goods originating in India (Notice No 2014/C 330/06). This partial review follows the application lodged by Pyrotek India Pvt. Ltd., an exporting producer from India. The review is limited in scope to the examination of the possibility of granting an exemption from the anti-dumping measure applicable as far as the applicant is concerned.

On September 9th, 2015, the European authorities terminated the partial interim review mentioned above and decided to grant an exemption to the Indian compay Pyrotek India Pvt. Ltd. (Commission Implementing Regulation (EU) No 2015/1507). This company is no longer subject to the anti-dumping measure imposed on December 16th, 2013 by Council Implementing Regulation (EU) No 1371/2013. This decision entered into force on the day following the publication of the regulation in the Official Journal of the European Union (L 236), i.e. on September 11th, 2015.

On 10 August 2016, the European Commission announced the initiation of a sunset review of the anti-dumping duty imposed on imports of certain open mesh fabrics of glass fibres from China (Notice No 2016/C 288/03). This follows the request lodged on 4 May 2016 by the Alliance for the Defence of Open Mesh Fabrics. Since the anti-dumping measure imposed on imports of open mesh fabrics of glass fibres from China was extended to imports of the same products originating in India and Indonesia, the sunset review and its conclusion will hold for these countries as well.
