NoOn February 12, 2009, the Argentinian authorities decided to impose a definitive anti-dumping duty on imports of certain parts of bicycle frames and forks, excepting pivots, from China (Resolution 43/2009, 12.02.2009).
The products subject to the duty are classified under the following HS code: 8714.9100.
The definitive duty consists of a minimum FOB price of USD 3.02 per kilogram. This anti-dumping duty entered into force on the day of the publication of the resolution in the Official Journal of the Argentinian Republic, i.e. on February 17, 2009.
The complaint was lodged by the Industrial Chamber of Motorcycle, Bicycle, wheeled Vehicle and Related (Cámara Industrial de la Motocicleta, Bicicleta, Rodados y Afines). It argued that the anti-dumping duty imposed on certain types of bicycles from China and Taiwan by Resolution 4/2002 dated May 22, 2002 was circumvented.
On November 12th, 2013, the Argentinian authorities decided to initiate an expiry review of the above-mentioned anti-dumping measure (Resolution 742/2013, 12.11.2013). The review was requested by the Industrial Chamber of Motorcycle, Bicycle, wheeled Vehicle and Related (Cámara Industrial de la Motocicleta, Bicicleta, Rodados y Afines). Resolution 742/2013 was published in the Official Journal of the Argentinian Republic on November 13th, 2013.
On May 12th, 2015, the Argentinian authorities concluded the expiry review and decided upon the continuation of the anti-dumping measure imposed on imports of the above-mentioned goods originating in China (Resolution 328/2015, 12.05.2015). This definitive anti-dumping duty entered into force on the day of the publication of the resolution in the Official Journal of the Argentinian Republic, i.e. on May 13th, 2015, and is applicable for a period of five years.
On 11 May 2020, the Argentinian authorities initiated a sunset review of the definitive duty imposed on the subject good from China.
