Anti-circumvention

On December 17, 2013, the European Commission decided to initiate an anti-circumvention investigation on imports of certain slightly modified open mesh fabrics of glass fibres from China (Commission Regulation (EU) No 1356/2013).

This investigation follows suspicion that the definitive anti-dumping duty imposed by Council Implementing Regulation (EU) No 791/2011 dated August 3, 2011 on imports of certain open mesh fabrics of glass fibres from China might be circumvented (see related intervention).
The products subject to investigation are classified under the following HS code: 7019.4000. The products concerned by the possible circumvention are classified under the following HS codes: 7019.5100 and 7019.5900.
The complaint was lodged on November 6, 2013 by Saint-Gobain Adfors CZ s.r.o., Tolnatext Fonalfeldolgozo, Valmieras 'Stikla Skiedra' AS and Vitrulan Technical Textiles GmbH.
Commission Regulation (EU) No 1356/2013 also makes imports of certain slightly modified open mesh fabrics of glass fibres originating in China subject to registration.
On September 15, 2014, the European Commission decided to extend the duty imposed by Council Implementing Regulation (EU) No 791/2011 dated August 3, 2011 on imports of certain open mesh fabrics of glass fibres from China to imports of certain slightly modified open mesh fabrics of glass fibres also originating in China (Commission Implementing Regulation (EU) No 976/2014). The rate of the duty ranges from 48.4% to 62.9% of the net free-at-Union-frontier price, depending on the company. This definitive duty entered into force on September 17, 2014.
Commission Implementing Regulation (EU) No 976/2014 was published in the Official Journal of the European Union (L 274) on September 16, 2014.

On 10 August 2016, the European Commission announced the initiation of a sunset review of the anti-dumping duty imposed on imports of certain open mesh fabrics of glass fibres from China (Notice No 2016/C 288/03). This follows the request lodged on 4 May 2016 by the Alliance for the Defence of Open Mesh Fabrics. Since the anti-dumping measure imposed on imports of open mesh fabrics of glass fibres from China was extended to imports of slightly modified open mesh fabrics of fibre glass from China following an anti-circumvention investigation, the sunset review and its conclusion will hold for this product as well.
 
On 8 November 2017, the European Commission extended the definitive antidumping duty imposed on imports of subject good from China following the conclusion of the above sunset review, see related intervention. The rate of duty is between 48.4% and 62.9% depending on the company. Since the anti-dumping measure imposed on imports of open mesh fabrics of glass fibres from China was extended to imports of slightly modified open mesh fabrics of fibre glass from China following an anti-circumvention investigation, the sunset review and its conclusion will hold for this product as well.
