Anti-dumping

On March 10th, 2009, the European Commission announced the initiation of a sunset review of the anti-dumping duty imposed on imports of sodium cyclamate from China and Indonesia (Notice No 2009/C 56/10).
The product subject to investigation is classified under the following HS code: ex 2929.9000.
This follows the request lodged on December 11th, 2008 by Productos Aditivos SA, the sole EU domestic producer of the subject good.

On June 3rd, 2010, the European authorities decided upon the continuation of the anti-dumping duty imposed on imports of sodium cyclamate from China and Indonesia (Council Implementing Regulation (EU) No 492/2010, 03.06.2010).
The amount of the duty imposed on imports originating in China is EUR 0.26 per kilogram, at the exception of the company Golden Time Enterprise (Shenzhen) Co. Ltd whose exports are subject to a duty of EUR 0.11 per kilogram. Moreover, the Chinese companies Fang Da Food Additive (Shen Zhen) Limited and Fang Da Food Additive (Yang Quan) Limited are not subject to the payment of any duty. The amount of the duty imposed on imports originating in Indonesia is EUR 0.27 per kilogram, at the exception of the company PT. Golden Sari (Chemical Industry) whose exports are subject to a duty of EUR 0.24 per kilogram.
This definitive duty entered into force on the day following the publication of the regulation in the Official Journal of the European Union (L 140), that is on June 9th, 2010.

The original anti-dumping duty was imposed by Council Regulation (EC) No 435/2004 dated March 8th, 2004 and entered into force on March 12th, 2004.

On February 17th, 2011, the European Commission announced the initiation of an interim review of the above-mentioned anti-dumping measure imposed on imports of sodium cyclamate from China and Indonesia (Notice No 2011/C 50/06).
It follows the request lodged by Productos Aditivos SA, the sole EU domestic producer.
The review is limited in scope to the examination of dumping as far as the Chinese exporting producer Golden Time Enterprise (Shenzhen) Co., Ltd is concerned.

On May 7th, 2012, the European authorities concluded the above-mentioned interim review and decided upon a modification of the anti-dumping measure imposed on imports of sodium cyclamate originating in China as far as the company Golden Time Enterprise (Shenzhen) Co., Ltd is concerned (Council Implementing Regulation (EU) No 398/2012, 07.05.2012). The new amount that applies to exports of those company is EUR 0.23 per kilogram (instead of EUR 0.11 per kilogram). This modification of the anti-dumping measure entered into force on the day following the publication of the regulation in the Official Journal of the European Union (L 124), that is on May 12th, 2012.

On June 6th, 2015, the European Commission announced the initiation of a sunset review of the anti-dumping duty imposed on imports of sodium cyclamate from China and Indonesia (Notice No 2015/C 189/02). This follows the request lodged on March 6th, 2015 by Productos Aditivos S.A., the sole EU domestic producer of the subject good.
 
On 17 July 2016, following a sunset review, the European Commission extended the definitive anti-dumping duty on imports of above product from China and Indonesia (Commission Implementing Regulation (EU) 2016/1160). The rate of duty on imports from China is EUR 0.23 or 0.26 per kg (approx. USD 0.26 or 0.29 per kg), depending on the company. The rate of duty on imports from Indonesia is EUR 0.24 or 0.27 per kg (approx. USD 0.27 or 0.3 per kg), depending on the company.
