On July 12, 2013, the European Commission announced the initiation of a sunset review of the anti-dumping duty imposed on imports of ammonium nitrate (solid fertilisers with an ammonium nitrate content exceeding 80 % by weight) from Russia (Notice No 2013/C 200/09). This follows the review lodged on March 28, 2013 by Fertilizers Europe (a European association of fertilisers manufacturers) on behalf of producers representing more than 25% of the EU production of the subject good. The products subject to investigation are classified under the following HS codes: 3102.3090, 3102.4090, 3102.2900, 3102.6000, 3102.9000, 3105.1000, 3105.2010, 3105.5100, 3105.5900 and 3105.9091.
On September 23, 2014, the Commission decided upon the continuation of the anti-dumping duty imposed on imports of ammonium nitrate originating in Russia (Commission Implementing Regulation (EU) No 999/2014). For details about the amount of the duty (that varies depending on the exact classification of the good and on the producing company), see Art. 1 of the Commission Implementing Regulation (EU) No 999/2014. The duty entered into force on the day following the publication of the regulation in the Official Journal of the European Union, that is on September 25, 2014.
The original anti-dumping duty was imposed by Council Regulation (EC) No 2022/95 dated August 16, 1995 and published in the Official Journal of the European Communities on August 23, 1995. It was then amended by Council Regulation (EC) No 663/98 dated March 23, 1998 and published in the Official Journal of the European Communities on March 26, 1998. It was extended a first time by Council Regulation (EC) No 658/2002 dated April 15, 2002 and published in the Official Journal of the European Communities on April 18, 2002. It was extended a second time by Council Regulation (EC) No 661/2008 dated July 8, 2008 and published in the Official Journal of the European Union on July 12, 2008.
On 19 February 2016, the European Commission amended the definitive measure imposing a specific duty on imports of ammonium nitrate from the KCKK Branch of Joint Stock Company United Chemical Company Uralchem in Kirovo-Chepetsk. The rate of the duty is EUR 47.07 (USD 53.49) per tonne.
On 16 November 2018, the European Commission amended the definitive duty imposed on imports of ammonium nitrate from Russia. The rate of duty is between EUR 28.78 and 32.71 per tonne and varies depending on the product classification and on the company. The regulation amending the definitive duty was published on 15 November 2018.
