Anti-dumping

On November 21, 2008, the Indian authorities initiated a sunset review of the anti-dumping duty imposed on imports of melamine from China.
The product subject to investigation is classified under the following HS code: 2933.6100.

On November 20, 2009, the Indian authorities issued their final findings of the sunset review. They recommended the continuation of the existing anti-dumping measure.

On February 19, 2010, the Indian authorities issued the notification of extension of the anti-dumping duty imposed on imports of melamine from China (Notification No. 10/2010-Customs, 19.02.2010). For details about the amount of the duty, see table of Notification No. 10/2010-Customs. This duty is effective for a period of five years.
The original anti-dumping duty was decided on September 3, 2004 and imposed by Notification No. 107/2004-Customs on November 16, 2004.

On December 6, 2014, the Indian authorities initiated a sunset review of the above-mentioned anti-dumping duty imposed on imports of melamine from China. This follows the application lodged by M/s. Gujarat State Fertilizers & Chemicals Ltd.

On January 7, 2015, the Indian authorities issued the notification of provisional extension of the anti-dumping duty imposed by Notification No. 10/2010-Customs dated February 19, 2010 (Notification No. 02/2015-Customs (ADD), 07.01.2015). This duty remains into force upto and inclusive of February 18, 2016.

On 5 December 2015, the Indian Directorate General of anti-dumping & allied duties, Ministry of Commerce, issued its final findings and recommended the imposition of a definitive anti-dumping duty on imports of melamine originating in or exported from China in conclusion of the above sunset review.

On 28 January 2016, the Indian Ministry of Finance issued the Customs Notification extending the definitive anti-dumping duty (Notification No. 2/2016-Customs (ADD), 28.01.2016). The amount of the duty imposed on imports originating in or exported from China is USD 331.10 per metric ton. This definitive duty is effective for a period of five years. Subsequently, the anti-dumping duty imposed by Notification No. 10/2010-Customs dated 19 February 2010 is rescinded by Notification No. 3/2016-Customs dated 28 January 2016.

On 6 September 2019, the Indian authorities issued Notification No. 34 /2019-Customs (ADD) amending the definitive duty imposed on imports of melamine from China. The rate of duty imposed on imports from the company Foshan Kaisino Building Material Co. Ltd. when the subject good is produced by Kuitun Jinjiang Chemical Industry Co. Ltd is USD 319.04 per metric ton. For all other Chinese companies, the rate of duty is USD 331.10 per metric ton.

On 22 September 2020, the Indian authorities initiated a sunset review of the definitive duty imposed on imports of melamine from China. This follows the application lodged by Gujarat State Fertilizers & Chemicals Limited.

On 6 January 2021, the Indian authorities extended the definitive duty on imports of the subject good from China until 28 February following the initiation of the sunset review.

On 25 February 2021, the Indian authorities extended the definitive duty on imports of melamine from China for the second time. The duty is extended until 31 March.
