Production subsidy

 On 2 November 2015, the German Agriculture Ministry announced a federal programme to increase energy efficiency in the country's agricultural and horticultural industries. The programme is the agricultural component of the National Action Plan for Energy Efficiency ("NAPE") and will be active from 1 January 2016 until the end of 2018.
The programme encompasses three projects, all directed and small and medium-sized entreprises in agriculture and horticulture:

  1. A 30% subsidy on all equipment modernisation related to energy efficiency (e.g. pumps, engines, lighting). The only exception shall be LED-lighting which will be subsidised at 15% and only in 2016. A "systemic modernisation" which includes the exchange of multiple components of a facility shall be subsidised at 20-30%, depending on the level of the increased energy efficiency (an increase of at least 25%).
  2. A subsidy of up to 40% for the construction of buildings used in the vegetable production, e.g. greenhouses. The construction must present an energy saving of at least 40% (60% for the maximum subsidy level).
  3. A de-minimis state aid for energy efficiency consulting with a maximum coverage level of 80% and 6'000 EUR.

According to 25th subsidy report by the Finance Ministry (cf. Sources), the government estimates the programme will cost 150 million EUR only in 2016.
In the GTA database the determination of whether a policy instrument discriminates against foreign commercial interests turns on whether it creates or alters the relative treatment of domestic firms versus foreign commercial interests. On this metric, the state aid proposed here is discriminatory because the state aid is not available to competing firms outside of the implementing jurisdiction.
