Import licensing requirement
On 16 September 2009, the Indonesian Ministry of Trade issued regulation 45/M-DAG/PER/9/2009 introducing a new import license regime. The former four license types (API-U, API-P, API-T and API-K) were replaced by an import license only for imports on behalf of third parties or trading activities (API-U) and an import license for own consumption or usage (API-P). Any firm can apply only for either of the two licenses (art. 5 of the regulation).
The regulation potentially hinders a number of companies, which previously obtained the API-T license. This license, issued to PMA (Indonesian for companies subject to foreign direct investment) and domestic capital investment companies, allowed using imported goods for both own consumption as well as trading. With the new regulations, each entity is limited to only one of the two activities.
The regulation came into force on 1 January 2010 and was revoked by regulation 39/M-DAG/PER/10/2010 on 1 January 2011 (cf. Related Measures).
