On November 24, 2009, the Argentinian authorities decided to initiate an anti-dumping investigation on imports of certain types of electric fans from China (Resolution 70/2009, 24.11.2009). The products subject to investigation are classified under the following HS codes: 8414.5110, 8414.5190 and 8414.5990. The complaint was lodged by Metalurgica Crivel S.C., Axel S.A. and Industrias Medano S.R.L. The investigation started on the day following the publication of the resolution in the Official Journal of the Argentinian Republic, i.e. on December 3, 2009.
On June 1, 2011, the Argentinian authorities decided to impose a definitive anti-dumping duty on imports of the investigated products from China (Resolution 194/2011, 01.06.2011). The rate of the definitive duty is 136.92% of the declared FOB price. This definitive anti-dumping duty entered into force on the day of the signature of the resolution, i.e. on June 1, 2011, and is applicable for a period of five years. Resolution 194/2011was published in the Official Journal of the Argentinian Republic on June 10, 2011.
On 1 June 2016, the Argentinian authorities decided to initiate a sunset review of the anti-dumping measure imposed on imports of above-mentioned products (Resolución 231/2016).This follows the request lodged by ELECTRONIC SYSTEM SA and AXEL SA. The duty will remain in force for the duration of this investigation.
On 1 December 2017, the Argentinian authorities extended the antidumping duty imposed on imports of the subject good from China following the conclusion of the above sunset review. The rate of duty is ad valorem 164% of the FOB value. The measure is in force for a period of five years.
On 18 December 2018, the Argentinian authorities initiated an anti-circumvention investigation on imports of certain types of electric fans from Viet Nam. The product subject to investigation is classified under the following HS code subheadings: 8414.5110, 8414.5190 and 8414.5990. This investigation follows suspicion that the definitive antidumping duty imposed by Resolution No. 701/2017 of 1 December 2017 on certain types of electric fans from China is being circumvented by being declared as originating from Viet Nam. The investigation follows the application lodged by the CÁMARA DE FABRICANTES DE VENTILADORES, ESTUFAS, PLANCHAS Y PRODUCTOS AFINES. The resolution initiating the investigation enters into force on 19 December 2018.
