Public procurement localisation

On 1 January 2014 entered into force Federal Law 44 FZ 'On the contracting system in state and municipal procurement of goods, works and services'.
It regulates federal and municipal orders related to the execution of national programmes, other documents with strategic planning content, international treaties and execution of the functions of the state and municipal bodies of the Russian Federation.
Article 14 (3) opens the possibility to restrict foreign participation in public tenders under certain circumstances:

  • protection of the constitutional order,
  • support of the country's defence and national safety,
  • protection of the domestic market of the Russian Federation,
  • development of the national economy,
  • support of the Russian producers by the Government of the Russian Federation.

While Law 44 FZ does not restrict foreign participation directly, the following legal acts have taken advantage of article 14(3) thusfar:

  • Decree No. 1224 of the Russian Government of 24 December 2013; 
  • Decree No. 656 of the Russian Government of 14 July 2014;
  • Decree No. 791 of the Russian Government of 11 August 2014; 
  • Decree No. 102 of the Russian Government of 5 February, 2015;
  • Federal Law No.188-FZ of 29 June 2015.

The affected sectors are identified on the basis of official statistical data from 2014 about the most frequent purpose of state procurement orders.
