ANNOUNCEMENT 19 Aug 2009

In August 2009, the government of India initiated a new anti-dumping investigation and a definitive duty was imposed in July 2011. In April 2016, a sunset review was initiated and the definitive duty was extended for a new period in July 2016. In February 2021, a sunset review was initiated.

Anti-dumping

On August 19, 2009, India initiated an anti-dumping investigation on imports of 1.11.2Tetrafluoroethane or R-134a of all types from China and Japan. The product subject to investigation is classified under the following HS code subheading: 2903.39.19.
 
On 19 April 2010, the Indian Ministry of Finance issued the Customs Notification imposing a provisional anti-dumping duty on the above products from China and Japan (Notification No. /2016-Customs (ADD)). The amount of duty imposed on imports from China is between USD 0.99 and 1.41 per kilogram depending on the company. The amount of duty imposed on imports from Japan is USD 1.63 per kilogram. The provisional duty is in force until 18 October 2010.
 
On 15 July 2011, the Indian Ministry of Finance issued the Customs Notification imposing a definitive anti-dumping duty on the above products from China and Japan. (Notification No. 61/2011-Customs (ADD)). The amount of duty imposed on imports from China is between USD 1.15 and 1.41 per kilogram depending on the company. The amount of duty imposed on imports from Japan is USD 0.69 per kilogram. The duty is in force for a period of five years.
 
On 10 April 2016, the Indian authorities initiated a sunset review of the above-mentioned anti-dumping duty imposed on imports of the subject goods originating in or exported from China. This follows the application lodged by SRF Ltd. Subsequently the duty applied to goods from Japan is terminated following its expiry.
 
On 11 July 2016, following the conclusion of the above-mentioned sunset review the Indian Ministry of Finance issued the Customs Notification extending the definitive anti-dumping duty (Notification No. 30/2016-Customs (ADD), 11.07.2016). The amount of the duty imposed on imports originating in or exported from China is USD 1.22 per kilogram. This definitive duty is in force for a period of five years.

On 19 February 2021, the Indian authorities initiated a sunset review of the definitive antidumping duty imposed on imports of the subject goods from China. The review follows the application lodged by SRF Limited.
