Anti-dumping

On August 11th, 2009, the Indian Directorate General of anti-dumping & allied duties, Ministry of Commerce, initiated an anti-dumping investigation on imports of phenol (also known as carbolic acid) from Japan and Thailand.
The product subject to investigation is classified under the following HS code subheadings: 2907.11 and 2907.60.
This follows the application lodged by M/s. Hindustan Organic Chemicals Limited and supported by M/S S I Group-India Ltd., the only two domestic producers of the subject good.
 
On February 3th, 2010, the Indian Directorate General of anti-dumping & allied duties, Ministry of Commerce and Industry, issued its preliminary findings and recommended the imposition of a provisional anti-dumping duty on imports of phenol originating in Japan and Thailand.
On April 19th, 2010, the Indian Ministry of Finance issued the Customs Notification imposing this provisional anti-dumping duty (Notification No. 53/2010-Customs, 19.04.2010). The duty is imposed on goods classified under the following HS codes: 2907.1110 and 2707.9900. The amount of the duty imposed on imports originating in Thailand is USD 247.25 per metric ton, at the exception of the producing company M/s PTT Phenol Company Limited whose exports are subject to a duty of USD 150.55 or 43.82 per metric ton (depending on the country of export and on the exporting company). The amount of the duty imposed on imports originating in Japan is USD 179.43 per metric ton, at the exception of the company M/s Mitsui Chemical Inc. whose exports are subject to a duty of USD 151.96 per metric ton. This provisional duty was effective upto and inclusive of October 18th, 2010.
 
On October 8th, 2010, the Indian Directorate General of anti-dumping & allied duties, Ministry of Commerce and Industry, issued its final findings and recommended the imposition of a definitive anti-dumping duty on imports of phenol originating in Japan and Thailand.
On December 1st, 2010, the Indian Ministry of Finance issued the Customs Notification imposing this definitive anti-dumping duty (Notification No. 120/2010-Customs, 01.12.2010). The duty is imposed on goods classified under the following HS codes: 2907.1110 and 2707.9900. The amount of the duty imposed on imports originating in Thailand is USD 172.53 per metric ton, at the exception of the company M/s PTT Phenol Company Limited whose exports are subject to a special treatment (please see the notification for further details). The amount of the duty imposed on imports originating in Japan is USD 547.03 per metric ton, at the exception of the company M/s Mitsui Chemicals Inc. whose exports are subject to a duty of USD 468.17 per metric ton. This definitive duty is effective for a period of five years from the date of imposition of the provisional anti-dumping duty, i.e. from April 19th, 2010.
 
On April 9th, 2015, the Indian authorities initiated a sunset review of the above-mentioned anti-dumping duty imposed on imports of phenol originating in Japan and Thailand. This follows the application lodged by M/s Hindustan Organic Chemicals Limited and M/s SI Group India Ltd. The product subject to investigation is classified under the following HS codes: 2907.1110 and 2707.9900.
On April 17th, 2015, the Indian authorities issued the notification of provisional extension of the anti-dumping duty imposed by Notification No. 120/2010-Customs dated December 1st, 2010 (Notification No. 14/2015-Customs (ADD), 17.04.2015). This duty remains into force upto and inclusive of April 18th, 2016.
