In July 2015, the government of Ukraine initiated a new safeguard investigation and in May 2016 a definitive duty was imposed. In April 2018, a sunset review was initiated and the definitive safeguard duty was extended for a new period in June 2019.

Safeguard

On July 7th, 2015, the Ukrainian Interdepartmental Commission of Foreign Trade initiated a safeguard investigation on imports of flexible porous plates, blocks and sheets of polyurethane foams. The products subject to investigation are classified under the following HS code: 3921.1310. This follows the application lodged by Interform LLC, Interform-Dnipro LLC, Interform-West LLC and Interform-M LLC, companies which accounted for 56% of the Ukrainian domestic production of the subject goods in 2014. According to the UN Comtrade Database, in 2014 the following countries exported goods classified under HS code subheading 3921.13 to Ukraine with a trade value over the GTA threshold of USD 1 million: Poland (USD 9.72 million), Italy (USD 4.46 million), Germany (USD 3.56 million), Hungary (USD 2.63 million), Romania (USD 2.18 million) and Slovenia (USD 2.13 million).

On 26 May 2016, with Decision No. SP-356/2016/4411-05, the Interdepartmental Commission on International Trade imposed safeguard measures on imports into Ukraine regardless of country of origin and export.

On 6 April 2018, the Ukrainian authorities initiated a sunset review of the definitive safeguard duty imposed on imports flexible porous plates, blocks and sheets of polyurethane foams. This follows the application lodged by Tov Interfoam, INTERFOM-DNIPRO, TOV, INTERFOM-ZAHID, TOV and INTERFOM-M, TOV.

On 28 June 2019, the Ukrainian authorities extended the definitive safeguard duty imposed on imports of the subject good following the conclusion of the sunset review. The rate of duty is in force from 8 July 2019 for a period of three years. The rate of duty imposed in the first year is 11.22 %. The rate of duty imposed in the second year is 10.66 %. The rate of duty imposed in the third year is 10.13 %. A number of developing countries are exempt from safeguard duties.
