On 10 September 2014, the Indonesian Ministry of Agriculture issued regulation 109/PERMENTAN/OT.140/9/2014 introducing restrictions for foreign workers in the horticulture sector.
The appendix of the regulation contains a detailed list of qualifications required in the positions where foreign citizens may be employed in the industry. Exceptions to these rules can be granted upon receiving a recommendation from the association of horticulture businesses (art. 6 of the regulation). Furthermore, foreigners without the listed qualifications may work in the given positions if no Indonesian with at least the same skills for the job can be found (art. 5).
The regulation came into force on 11 September 2014 and implements article 15 of law 13/2010 (cf. Related Measures).
