In December 2008, the European Commission imposed a new definitive duty on imports of welded tubes and pipes from Belarus, China and Russia as well as extended the definitive duty on imports from Thailand and Ukraine. In December 2013, a sunset review was initiated and the definitive duty was extended for a new period on imports of the subject good from Belarus, China and Russia. The definitive duty imposed on imports from Thailand and Ukraine was terminated.

Anti-dumping


On December 16, 2008, the European authorities decided to impose a definitive anti-dumping duty on imports of certain welded tubes and pipes of iron or non-alloy steel from Belarus, China and Russia following an antidumping investigation initiated on 26 September 2007. The rate of the duty imposed on imports originating in Belarus is 38.1% of the net free-at-Community-frontier price. The rate of the duty imposed on imports originating in China is 90.6% of the net free-at-Community-frontier price. The rate of the duty imposed on imports originating in Russia is 20.5% of the net free-at-Community-frontier price, at the exception of the groups OMK Group and TMK Group whose subsidiaries' exports are subject to a duty of 10.1% and 16.8% respectively. The duty entered into force on the day following the publication of the resolution in the Official Journal of the European Union (L 343), i.e. on December 20, 2008. The resolution additionally extended the definitive duty of the subject good imposed on imports from Thailand and Ukraine, see related intervention. The subject good is classified under HS code subheadings: ex 7306 30 41, ex 7306 30 49, ex 7306 30 72 and ex 7306 30 77. 
 
On December 19, 2013, the European Commission announced the initiation of a sunset review of the anti-dumping duty imposed by Council Regulation (EC) No. 1256/2008 dated 16.12.2008 on imports of certain welded tubes and pipes of iron or non-alloy steel originating in Belarus, China and Russia (Notice No 2013/C 372/10). The request for the review was lodged on September 18, 2013 by the Defence Committee of the welded steel tubes industry of the European Union on behalf of producers representing more than 25% of the EU production of the subject goods. The notice additionally initiated a sunset review for the definitive duty imposed on imports from Ukraine, see related intervention. 

On January 26, 2015, the European authorities decided upon the continuation of the definitive anti-dumping duty imposed on imports of certain welded tubes and pipes of iron or non-alloy steel from Belarus, China and Russia (Commission Implementing Regulation (EU) No 2015/110, 26.01.2015). The rate of the duty imposed on imports originating in Belarus remains 38.1% of the net free-at-Union-frontier price. The rate of the duty imposed on imports originating in China remains 90.6% of the net free-at-Union-frontier price. The rate of the duty imposed on imports originating in Russia remains 20.5% of the net free-at-Union-frontier price, at the exception of the groups OMK Group and TMK Group whose subsidiaries' exports are still subject to a duty of 10.1% and 16.8% respectively. This extension entered into force on the day following the publication of the resolution in the Official Journal of the European Union (L 20), i.e. on January 28, 2015.

On 3 September 2019, the European Commission issued Commission Implementing Regulation (EU) 2019/1382 amending or suspending the definitive duty imposed on imports of certain welded tubes and pipes of iron or non-alloy steel from Belarus, China and Russia if a specific safeguard duty is also imposed on the same good. More specifically, in cases when the definitive safeguard duty of 25% out of quota is applied on the same good (see related state act) the definitive antidumping duty imposed on imports from Russia is suspended whilst the definitive duty on imports from China and Belarus is reduced. The rate of reduced definitive duty on imports from China is 65.6%. The rate of reduced definitive duty on imports from Belarus is 13.1%. This decision follows a notice issued in April 2019 and following comments from interested parties.

Anti-dumping

On 20 December 2008, the European Union extended the definitive duty imposed on imports of certain welded tubes and pipes from Ukraine and Thailand following the conclusion of the sunset review initiated in September 2007. The goods subject to definitive duties fall under the following HS code subheadings: ex 7306 30 41, ex 7306 30 49, ex 7306 30 72 and ex 7306 30 77. The rate of the duty imposed on imports originating in Thailand is 35.2% of the net free-at-Community-frontier price, at the exception of the company Saha Thai Steel Pipe Co. Ltd whose exports are subject to a duty of 21.7%. The rate of the duty imposed on imports originating in Ukraine is 44.1% of the net free-at-Community-frontier price, at the exception of the companies OJSC Interpipe Nihnedeneprovsky Tube Rolling Plant and OJSC Interpipe Novomoskovsk Pipe Production Plant whose exports are subject to a duty of 10.7%. The regulation extending the definitive duty was published on 19 December 2008. On 19 December 2013, the European Commission initiated a sunset review of the antidumping duty imposed on imports of the subject good from Ukraine. The investigation follows the application lodged on 18 September 2013 by the Defence Committee of the welded steel tubes industry of the European Union. No sunset review was initiated on imports of the subject good from Thailand.

On 27 January 2015, the European Commission issued its conclusion of the sunset review and terminated the definitive duty retrospectively from 20 December 2013.
