Anti-subsidy

On July 14, 2008, the US International Trade Commission decided to initiate an anti-subsidy investigation on imports of tow-behind lawn groomers from China.
The products subject to investigation are classified under the following HS codes: 8432.4000, 8432.8000, 8432.9000, 8479.8998, 8479.9094 and 9603.5000.
The complaint was lodged on June 24, 2008 by Agri-Fab Inc. The notice of initiation is effective from the date of its publication in the Federal Register, i.e. on July 21, 2008.
An anti-dumping investigation was also initiated simultaneously (see measure 8081).
On August 20, 2008, the US International Trade Commission extended the due date for the preliminary determination to no later than November 17, 2008. This decision was published in the Federal Register on August 26, 2008.
On November 17, 2008, the US International Trade Commission made a preliminary affirmation of subsidisation and decided to impose a provisional countervailing duty on the above-mentioned products originating in China. The rate of the duty ranges from 0.95% (de minimis) to 254.52%, depending on the company. This duty entered into force on the day of the publication of the notice in the Federal Register, i.e. on November 24, 2008.
On June 12, 2009, the US International Trade Commission made a final determination of subsidisation and revised the rate of the countervaling duty imposed on imports of tow-behind lawn groomers from China: from 0.56% (de minimis) to 264.98%, depending on the company. This duty entered into force on the day of the publication of the notice in the Federal Register, i.e. on June 19, 2009.
On July 27, 2009, the US International Trade Commission made a final determination of material injury for US firms by reason of imports from China that have been found by the Department of Commerce to be subsidised by the Government of China. The notice was published in the Federal Register on July 31, 2009.
On August 3, 2009, the countervailing duty order of the US Department of Commerce imposing a definitive CVD on imports of tow-behind lawn groomers originating in China was published in the Federal Register. The rate of this definitive duty ranges from 0.56% to 264.98%, depending on the company.
 
On June 20, 2014, the US International Trade Administration automatically initiated a five-year sunset review. The notice of initiation was published in the Federal Register on July 1, 2014.
On September 17, 2014, the US International Trade Administration decided to revoke the countervailing duty order. Reason for this decision is the fact that the domestic interested parties did not participate in the sunset review. This notice was published in the Federal Register on September 23, 2014.
On September 29, 2014, the US International Trade Commission issued the notice of termination of the five-year sunset review. This notice was published in the Federal Register on October 2, 2014.
