Anti-dumping

On December 20, 2014, the European Commission announced the initiation of an anti-dumping investigation on imports of tubes and pipes of ductile cast iron (also known as spheroidal graphite cast iron) from India (Notice No 2014/C 461/17). The products subject to investigation are classified under the following HS codes: ex 7303.0010 and ex 7303.0090. The complaint was lodged on November 10, 2014 by Saint-Gobain PAM, Saint-Gobain PAM Deutschland GmbH and Saint-Gobain PAM España SA, on behalf of producers representing more than 25% of the EU production of the subject goods.
 
On September 18th, 2015, the European Commission decided to impose a provisional anti-dumping duty on imports of the above-mentioned products originating in India (Commission Implementing Regulation (EU) No 2015/1559). The rate of this duty is 31.2% of the net free-at-Union-frontier price, at the exception of the company Electrosteel Casting Ltd. whose exports are subject to a duty of 15.3%.
This provisional duty entered into force on the day following the publication of the resolution in the Official Journal of the European Union (L 244), i.e. on September 20th, 2015, and will apply for a period of six months.
 
On 19 March 2016, the European Commission imposed a definitive anti-dumping duty on imports of above product from India (Commission Implementing Regulation (EU) No 2016/388). The amount of duty is 14.1% of the net free-at-Union-frontier price with the exception of Electrosteel Castings Ltd. whose exports are not subject to duties.
 
On 12 August 2016, the European Commission amended the above definitive duty. The duty is amended to 19% of the net free-at-Union-frontier price with the exception of Electrosteel Castings Ltd. whose exports are subject to 4.1%. The amendment came into force the 13 August 2016, however changes are applied retroactively as from 19 March 2016
