Anti-dumping

On July 14, 2008, the US International Trade Commission decided to initiate an anti-dumping investigation on imports of tow-behind lawn groomers from China.
The products subject to investigation are classified under the following HS codes: 8432.4000, 8432.8000, 8432.9000, 8479.8998, 8479.9094 and 9603.5000.
The complaint was lodged on June 24, 2008 by Agri-Fab Inc.
The notice of initiation is effective from the date of its publication in the Federal Register, i.e. on July 21, 2008.
An anti-subsidy investigation was also initiated simultaneously (see measure 8106).
On November 10, 2008, the US International Trade Commission postponed the deadline for the preliminary determination by 50 days, i.e. until January 21, 2009. This decision was published in the Federal Register on November 17, 2008.
On January 16, 2009, the US International Trade Commission made a preliminary affirmation of dumping and decided to impose a provisional anti-dumping duty on the above-mentioned products originating in China. The rate of the duty ranges from 12.07% to 324.43%, depending on the company. This duty entered into force on the day of the publication of the notice in the Federal Register, i.e. on January 28, 2009.
On June 12, 2009, the US International Trade Commission made a final determination of sales at less than fair value (dumping) and revised the rate of the anti-dumping duty imposed on imports of tow-behind lawn groomers from China: 386.28%, at the exception of the companies Nantong D & B Machinery Co. Ltd. and Qingdao Huatian Truck Co. Ltd. (a.k.a. Qingdao Huatian Hand Truck Co. Ltd.), whose exports are subject to a duty of 154.72%. This duty entered into force on the day of the publication of the notice in the Federal Register, i.e. on June 19, 2009.
On July 27, 2009, the US International Trade Commission made a final determination of material injury for US firms by reason of imports from China that have been found by the Department of Commerce to be sold in the United States at less than fair value. The notice was published in the Federal Register on July 31, 2009.
On August 3, 2009, the anti-dumping duty order of the US Department of Commerce imposing a definitive anti-dumping duty on imports of tow-behind lawn groomers originating in China was published in the Federal Register. The rate of this definitive duty is 386.28%, at the exception of the companies Nantong D & B Machinery Co. Ltd. and Qingdao Huatian Truck Co. Ltd. (a.k.a. Qingdao Huatian Hand Truck Co. Ltd.), whose exports are subject to a duty of 154.72%.
 
On June 20, 2014, the US International Trade Administration automatically initiated a five-year sunset review. The notice of initiation was published in the Federal Register on July 1, 2014.
On October 24, 2014, the US International Trade Administration found that revocation of the existing anti-dumping duty order on certain tow-behind lawn groomers from China would be likely to lead to continuation or recurrence of dumping. This notice was published in the Federal Register on November 4, 2014.
In a vote on January 12, 2015 the U.S. International Trade Commission renewed the existing anti-dumping order against imports of tow-behind lawn groomers and parts thereof from China.
