Anti-dumping

On October 15, 2013, the European Commission announced the initiation of a sunset review of the anti-dumping duty imposed on imports of certain tube and pipe fittings (other than cast fittings, flanges and threaded fittings) of iron or steel (not including stainless steel), with a greatest external diameter not exceeding 609.6mm, from Malaysia and South Korea (Notice No 2013/C 299/05).
This follows the request lodged on June 26, 2013 by the Defence Committee of the Steel Butt-Welding Fittings Industry of the European Union on behalf of producers representing more than 25% of the EU production of the subject goods.
The products subject to investigation are classified under the following HS codes: ex 7307.9311, ex 7307.9319 and ex 7307.9980.

On December 2, 2014, the Commission decided upon the continuation of the anti-dumping duty imposed on imports of certain tube and pipe fittings originating in Malaysia and South Korea (Commission Implementing Regulation (EU) No 1283/2014). The rate of the duty imposed on imports originating in Malaysia is 75.0% of the net free-at-Union-frontier price, at the exception of the companies Pantech Steel Industries Sdn Bhd and Anggerik Laksana Sdn Bhd whose exports are subject to a duty of 49.9% and 59.2% respectively. The rate of the duty imposed on imports originating in South Korea is 44.0% of the net free-at-Union-frontier price.
The duty entered into force on the day following the publication of the regulation in the Official Journal of the European Union (L 347), that is on December 4, 2014, and shall expire on January 29, 2018.

The original anti-dumping duty was imposed by Council Regulation (EC) No 1514/2002 dated August 19, 2002 and published in the Official Journal of the European Communities on August 24, 2002. It was extended a first time by Council Regulation (EC) No 1001/2008 dated October 13, 2008 and published in the Official Journal of the European Communities on October 16, 2008.

On February 18, 2015, the European Commission announced the initiation of a partial interim review of the anti-dumping measure imposed on December 2, 2014 by Commission Implementing Regulation (EU) No 1283/2014 (Notice No 2015/C 58/08).
This follows the application lodged by TK Corporation, a South Korea exporter.
The partial interim review is limited in scope to the examination of dumping as far as the applicant is concerned. The request is based on prima facie evidence, provided by the applicant, that, as far as the applicant is concerned, and as far as dumping is concerned, the circumstances on the basis of which the existing measures were imposed have changed and that these changes are of a lasting nature.
On 5 March 2016, based on the above-mentioned partial interim review, the European Commission imposed a separate definitive anti-dumping duty of 32.4% on imports of certain tube and pipe fittings of iron and steel from the South Korean company TK Corporation. All other companies from South Korea remain subject to the original duty of 44%.

On 27 January 2018, the European Commission initiated a sunset review of the antidumping duty imposed on imports of the subject good from the Republic of Korea and Malaysia. The investigation follows the application lodged on 25 October 2017 by the Defence Committee of the Steel Butt-Welding Fittings Industry.
