In April 2009, the European Commission imposed a provisional duty and a definitive duty was imposed in October 2009. In October 2014, a sunset review was initiated and the definitive duty was extended for a new period on imports from China in December 2015. In December 2020, a sunset review was initiated. In September 2021, the definitive duty was extended to imports from Thailand following to an anti-circumvention investigation.

Anti-dumping

On October 6, 2009, through Council Regulation (EC) No. 925/2009 (dated 24 September 2009), a definitive anti-dumping duty was imposed on imports of certain aluminium foil originating in Armenia, Brazil and the People's Republic of China. Notably, a provisional duty was imposed on 7 April 2020.
The exact product affected is aluminium foil of a thickness of not less than 0,008 mm and not more than 0,018 mm, not backed, not further worked than rolled, in rolls of a width not exceeding 650 mm. The product subject to the duty is classified under the following HS code: 7067.1119 (TARIC code 7607 11 19 10).
The duty was established at the level of 13.4 % for Closed Joint Stock Company Rusal-Armenal from Armenia and 13.4% for all other Armenian companies, for China 6.4% for Alcoa (Shanghai) Aluminium Products Co., Ltd and Alcoa (Bohai) Aluminium Industries Co., Ltd, 20.3% for Shandong Loften Aluminium Foil Co., Ltd 24.2% for Zhenjiang Dingsheng Aluminium Co., Ltd and 30.0% for all other companies from China. Companhia Brasileira de Aluminio from Brazil faces 17.6% duty and all other companies from Brazil 17.6%.
On 22 October 2012, the EC started an investigation concerning the possible circumvention of the above anti-dumping measure on imports of certain aluminium foil originating in the People's Republic of China.
This investigation was requested by 4 European Aluminium foil producers, namely: Symetal SA, Eurofoil Luxembourg SA, Alcomet and Hydro Aluminium Rolled Products GmbH.
On July 2, 2013 the European Commission decided to terminate the investigation concerning possible circumvention of anti-dumping measures imposed by Council Regulation (EC) No 925/2009. This decision entered into force on July 4, 2013.
 
On 4 October 2014, the European Commission initiated a sunset review of the anti-dumping duty imposed on imports of certain aluminium foil originating in Brazil and China. (Notice No 2014/C 350/09). This follows the request lodged on 30 June 2014 by AFM Aluminiumfolie Merseburg, Alcomet AD, Eurofoil Luxembourg S.A., Hydro Aluminium Rolled Products GmbH, Impold.o.o. and Symetal S.A. on behalf of producers representing more than 25% of the total EU production of the subject goods. The request did not include the initiation of a sunset review against imports from Armenia these measures thus lapsed on 7 October 2014.

On 18 December 2015, the European Commission decided upon the continuation of the anti-dumping duty imposed on imports of certain aluminium foils originating in China and to terminate the investigation concerning imports originating in Brazil. (Commission Implementation Regulation (EU) No. 2015/2384). The amount of the duty is between 6.4% and 30% of the net free-at-Union-frontier price depending on the exporting company.

On 17 December 2020, the European Commission initiated a sunset review of imports of the subject good from China. The review follows the application lodged on 10 September 2020 by the domestic industry.

Anti-dumping

Companhia Brasileira de Aluminio from Brazil faces 17.6% duty and all other companies from Brazil 17.6%.

On 4 October 2014, the European Commission terminated the definitive duty on imports of the subject good from Armenia as of 7 October 2014. Additionally, the Commission initiated a sunset review of the antidumping duty imposed on imports of certain aluminium foil originating in Brazil and China, see related interventions.

Anti-circumvention

On 21 December 2020, the European Commission initiated an anti-circumvention investigation on imports of certain aluminium foil from China. This investigation follows suspicion that the definitive anti-dumping duty imposed by Implementing Regulation (EU) 2015/2384 and Implementing Regulation (EU) 2017/271 on imports of the same products consigned from Thailand, whether declared as originating in Thailand or not, might be circumvented (see related intervention). The products subject to investigation are classified under HS code subheading 7607.11.19. This investigation follows the application lodged on 9 November 2020 by an applicant requesting anonymity. 

On 16 September 2021, the European Commission extended the definitive anti-dumping duty imposed on imports of certain aluminium foil from China (see related intervention) to imports of the same products consigned from Thailand, whether declared as originating in Thailand or not. The rate of duty is 30% of the net free-at-Union-frontier price before duty. The regulation extending the definitive duty was issued on 15 September 2021.
