Anti-dumping

On October 8, 2007, the Mexican Ministry of Economy decided to initiate an anti-dumping investigation on imports of valves without caps and plastic atomizers from China.
The products subject to investigation are classified under the following HS code: 9616.1001.
The complaint was lodged on May 21, 2007 by OLAN de México, S.A. de C.V. The investigation started on the day following the publication of the resolution in the Official Journal of the Federation, i.e. on October 18, 2008.
 
On December 9, 2008, the Mexican authorities decided to impose a provisional anti-dumping duty on imports of plastic atomizers originating in China. The rate of the duty is 114%. This provisional anti-dumping duty entered into force on the day following the publication of the resolution in the Official Journal of the Federation, i.e. on December 18, 2008. No provisional duty was imposed on imports of valves without caps.
 
On April 16, 2009, the Mexican authorities decided to impose a definitive anti-dumping duty on imports of plastic atomizers originating in China. The rate of the duty is 86%.This definitive anti-dumping duty entered into force on the day following the publication of the resolution in the Official Journal of the Federation, i.e. on April 22, 2009. No definitive duty was imposed on imports of valves without caps.
 
On April 1, 2014, the Mexican Ministry of Economy decided to initiate a sunset review of the anti-dumping measure imposed on April 16, 2009. This review follows the applications lodged on March 13, 2014 by OLAN de México, S.A. de C.V. The investigation started on the day following the publication of the resolution in the Official Journal of the Federation, i.e. on April 10, 2014.
The existing anti-dumping duty remains enforced during the review.
 
On January 30, 2015, the Mexican authorities terminated the review and decided upon the continuation of the anti-dumping measure imposed on imports of plastic atomizers originating in China. The rate of the duty remains 86%. This duty entered into force on the day following the publication of the resolution in the Official Journal of the Federation, i.e. on February 17, 2015. It shall be enforced for a period of five years, starting from April 22, 2014.
