Anti-dumping

On September 4, 2014, the European Commission announced the initiation of an anti-dumping investigation on imports of acesulfame potassium, as well as acesulfame potassium contained in preparations and/or mixtures comprising also other sweeteners and/or water, from China (Notice No 2014/C 297/02). The products subject to investigation are classified under the following HS codes: ex 2106.9092, ex 2106.9098, ex 2934.9990 and ex 3824.9097.
The complaint was lodged on July 22, 2014 by Nutrinova Nutrition Specialties & Food Ingredients GmbH, company representing 100% of the EU production of the subject goods.
 
On May 19th, 2015, the European Commission decided to impose a provisional anti-dumping duty on imports of acesulfame potassium originating in China falling (Commission Implementing Regulation (EU) No 2015/787). 
The amount of this duty is EUR 3.19 per kilogram, at the exception of the companies Anhui Vitasweet Food Ingredient Co., Ltd and Suzhou Hope Technology Co., Ltd whose exports are subject to a duty of EUR 1.23 per kilogram and EUR 3.15 per kilogram respectively. For preparations and/or mixtures containing acesulfame potassium, this duty shall be applicable in proportion in the preparations and/or mixtures, by weight, of the total content of acesulfame potassium.
This provisional duty entered into force on the day following the publication of the resolution in the Official Journal of the European Union (L 125), i.e. on May 22nd, 2015, and will apply for a period of six months.
 
On October 30th, 2015, the European Commission decided to impose a definitive anti-dumping duty on imports of acesulfame potassium originating in China under HS code subheading 2934.99.90 (Commission Implementing Regulation (EU) No 2015/1963). The amount of this duty is EUR 4.58 per kilogram, at the exception of the companies Anhui Vitasweet Food Ingredient Co., Ltd and Suzhou Hope Technology Co., Ltd whose exports are subject to a duty of EUR 2.64 per kilogram and EUR 4.47 per kilogram respectively.
This definitive duty entered into force on the day following the publication of the resolution in the Official Journal of the European Union (L 287), i.e. on November 1st, 2015. No duty was imposed on imports of the subject good falling under HS code subheading ex 2106.9092, ex 2106.9098, and ex 3824.9097.

On 30 October 2020, the European Commission initiated a sunset review of imports of the subject good from China. The review follows the application lodged on 31 July 2020 by Celanese Sales Germany GmbH.
