Export-related non-tariff measure, nes

On 30 March 2011, the Indonesian Ministry of Finance issued regulation 63/PMK.04/2011 concerning customs registration.
Compared to the previous regulation 124/PMK.04/2007 where only importers were required to obtain Customs ID Numbers (NIK), the new regulation stipulates this obligation also for exporters, transporters and customs brokers (art. 11 of regulation 63/PMK.04/2011).
Similar to the previous restrictions for importers (art. 11 of regulation 124/PMK.04/2007 ), the Customs ID Numbers are not needed in the case of:

  • 'a. goods belonging to representative of foreign countries along with their officials assigned in Indonesia;
  • b. goods needed by international agencies along with their officials assigned in Indonesia;
  • c. luggage of passengers, crew member of transportation means, cross-borderers and delivery goods;
  • d. personal effect;
  • e. delivery goods/grants for the need of general worship, charity, social, cultural activities or in the interest of natural disaster mitigation;
  • f. goods for the need of the central government or regional government designated to public interest; and/or
  • g. goods securing import approval without API 'Importer Identification Number'.'(art. 17(1) of regulation 63/PMK.04/2011)

Also, the following goods are freed from the given obligation:

  • 'a. delivery goods;
  • b. personal effect;
  • c. goods belonging to representatives of foreign countries or international agencies;
  • d. goods for the need of general worship, social activity, education, culture or sports;
  • e. souvenirs;
  • f. samples;
  • g. goods for the need of research; and/or
  • h. export executed by individual person.' (art. 17(2) of regulation 63/PMK.04/2011)

The regulation came into force 90 days after it has been promulgated, i.e. on 1 July 2011. However, on 27 June 2011, the Ministry issued amendment 95/PMK.04/2011 postponing the obligation for the registration to 1 January 2012.
This regulation was revoked when regulation 59/PMK.04/2014 came into force on 1 June 2014 (cf. Related Measures) and is therefore no longer implemented.
