In August 2013, the government of Brazil initiated a new anti-dumping investigation and the definitive duty was extended in August 2014. In August 2019, a sunset review was initiated. In August, the definitive duty imposed on imports from China was extended for a new period and immediately suspended. The definitive duty on imports from the Republic of Korea was terminated.

Anti-dumping

On August 14, 2014, the Brazilian authorities, after having conducted an expiry review, decided upon the continuation of the anti-dumping duty imposed on imports of polyvinyl chloride resin from China and South Korea (Resolution No. 68, 14.08.2014). The products subject to the duty are classified under the following HS code: 3904.1010. The rate of duty imposed on imports originating in China is 21.6%. The rate of the duty imposed on imports originating in South Korea is 18.9%, at the exception of the company LG Chem Ltd. whose exports are subject to a duty of 2.7%. This definitive anti-dumping duty entered into force on the day of the publication of the resolution in the Federal Official Gazette of Brazil, i.e. on August 15, 2014, and is applicable for a period of five years.
This duty follows an expiry review requested on March 27, 2013 by Braskem S.A. A review was then initiated by the Secretary for Foreign Trade of the Brazilian Ministry of Development, Industry and Foreign Trade on August 28, 2013 (Circular No. 48, 28.08.2013). The review started on the day of the publication of the circular in the Federal Official Gazette of Brazil, i.e. on August 29, 2013. The original anti-dumping duty entered into force on August 29, 2008 (Resolution No. 51, 28.08.2008).

On 15 August 2019, the Brazilian authorities initiated a sunset review of the antidumping duty imposed on imports of the subject good from China and the Republic of Korea. This follows the application lodged on 11 April 2019 by Braskem S.A.

On 14 August 2020, the Brazilian authorities extended the definitive duty imposed on imports of the subject good from China following the conclusion of a sunset review. The rate of duty on imports from China is 21.6%. The duty is in force for a period of five years. However, the imposed duty is immediately suspended and will only be resumed if imports of the subject good are increased above a certain level. The resumption of duties will be resumed following a petition by the domestic industry. The definitive duty imposed on imports from the Republic of Korea was not extended and this the duty expired.
