Anti-dumping

On June 18, 2008, the Secretary for Foreign Trade of the Brazilian Ministry of Development, Industry and Foreign Trade decided to initiate an anti-dumping investigation on imports of plastic syringes (for general use, with capacities of 1ml, 3ml, 5ml, 10ml or 20ml, with or without needle) from China (Circular No. 37, 18.06.2008).
The products subject to investigation are classified under the following HS codes: 9018.3111 and 9018.3119.
The complaint was lodged on November 23, 2007 by Becton Dickinson Indústrias Cirúrgicas Ltda. The investigation started on the day of the publication of the circular in the Federal Official Gazette of Brazil, i.e. on June 19, 2008.
On September 17, 2009, the Brazilian authorities decided to impose a definitive anti-dumping duty on imports of plastic syringes originating in China (Resolution No. 53, 17.09.2009). The amount of the duty is USD 10.67 per kilogram, at the exception of the company Shanghai Kindly Enterprise Development Group Co. Ltd. whose exports are subject to a duty of USD 7.73 per kilogram. This definitive duty entered into force on the day of the publication of the resolution in the Federal Official Gazette of Brazil, i.e. on September 18, 2009, and is applicable for a period of five years.
 
On September 16, 2014, the Brazilian authorities decided to initiate a sunset review of the anti-dumping duty imposed by Resolution No. 53 dated September 17, 2009 on imports of plastic syringes originating in China (Circular No. 54, 16.09.2014).
This sunset review started on the day of the publication of the circular in the Federal Official Gazette of Brazil, i.e. on September 17, 2014. It follows a request lodged on April 30, 2014 by Becton Dickinson Indústrias Cirúrgicas Ltda.
 
On June 19th, 2015, the Brazilian authorities decided upon the continuation of the definitive anti-dumping duty imposed on imports of plastic syringes originating in China (Resolution No. 58, 19.06.2015). The amount of the duty is USD 4.55 per kilogram. This definitive duty entered into force on the day of the publication of the resolution in the Federal Official Gazette of Brazil, i.e. on June 22nd, 2015, and is applicable for a period of five years.
