Anti-dumping

On March 17, 2008, the Argentinian Ministry of Economy and Public Finance decided to initiate an anti-dumping investigation on imports of acrylic fibre yarns (single, multiple or cabled yarns), with a content of acrylic or modacrylic staple fibres of at least 85%, from Brazil and Indonesia (Resolution 68/2008, 17.03.2008). The products subject to investigation are classified under the following HS codes: 5509.3100 and 5509.3200. The complaint was lodged by Edolan S.A.I.C., Pastora Neuquen S.A. and Pastora Rioja S.A. The investigation started on the day following the publication of the resolution in the Official Journal of the Argentinian Republic, i.e. on March 26, 2008. On April 6, 2009, the Argentinian authorities decided to impose a provisional anti-dumping duty on imports of acrylic fibre yarns from Indonesia (Resolution 111/2009, 06.04.2009). The rate of the provisional duty is 20.71% of the FOB price for all the Indonesian exporters. This provisional anti-dumping duty entered into force on the day following the publication of the resolution in the Official Journal of the Argentinian Republic, i.e. on April 14, 2009, and is applicable for a period of four months. No provisional duty was imposed on imports from Brazil. On September 24, 2009, the Argentinian authorities decided to impose a definitive anti-dumping duty on imports of acrylic fibre yarns from Brazil and Indonesia (Resolution 398/2009, 24.09.2009). The rate of the definitive duty imposed on Austrian exports is 20.71% of the FOB price. The rate of the definitive duty imposed on Brazilian exports is 121.45% at the exception of the exporting company Paramount Texteis Industria e Comercio S.A. whose exports are subject to a duty of 14.39% for goods classified under HS code 5509.3100 and of 21.85% for goods classified under HS code 5509.3200. This definitive anti-dumping duty entered into force on the day following the publication of the resolution in the Official Journal of the Argentinian Republic, i.e. on September 26, 2009, and is applicable for a period of five years. On May 28, 2010, the Argentinian authorities decided to initiate a review for changed circumstances of the anti-dumping duty imposed on imports of acrylic fibre yarns from Brazil decided on September 24, 2009 with Resolution 398/2009 (Resolution 202/2010, 28.05.2010). On June 3, 2011, the Argentinian decided not to modify the anti-dumping duty imposed on imports of acrylic fibre yarns from Brazil decided on September 24, 2009 with Resolution 398/2009 (Resolution 202/2011, 03.06.2011). Resolution 202/2011 was published in the Official Journal of the Argentinian Republic on June 30, 2011 and is effective until September 25, 2014.
