Anti-dumping

On June 20, 2014, the Secretary for Foreign Trade of the Brazilian Ministry of Development, Industry and Foreign Trade decided to initiate an anti-dumping investigation on imports of elastomeric rubber tubes from Germany, Israel, Italy, Malaysia, Republic of Korea and the United Arab Emirates (Circular No. 36, 20.06.2014). The products subject to investigation are classified under the following HS code: 4009.1100. The complaint was lodged on April 30, 2014 by Armacell do Brasil Ltda., which is the sole domestic producer of the goods under scrutiny. The investigation started on the day of the publication of the circular in the Federal Official Gazette of Brazil, i.e. on June 25, 2014.
 
On October 27, 2014, the Brazilian Ministry of Development, Industry and Foreign Trade made a preliminary determination of dumping against imports of elastomeric rubber tubes originating in Germany, Israel, Italy, Malaysia, Republic of Korea and the United Arab Emirates (Circular No. 64, 27.10.2014). Up to May 27th, 2015 no provisional duty was imposed yet. The investigation continues until the final determination. Circular No. 64 was published in the Federal Official Gazette of Brazil on October 28, 2014.
 
On April 23rd, 2015, the Brazilian authorities terminated the investigation as far as the Republic of Korea as country of origin is concerned (Circular No. 26, 23.04.2015). Reason for this decision is that the imported volume is not significant. Circular No. 26 was published in the Federal Official Gazette of Brazil on April 24th, 2015.
 
On June 19th, 2015, the Brazilian authorities decided to impose a definitive anti-dumping duty on imports of elastomeric rubber tubes from Germany, Israel, Italy, Malaysia and the United Arab Emirates (Resolução No. 57, 19.06.2015). The rate of the duty imposed on imports originating in Germany is 76%. The rate of the duty imposed on imports originating in the United Arab Emirates is 21%. The rate of the duty imposed on imports originating in Israel is 70.1%. The rate of the duty imposed on imports originating in Italy is 118.1%. The rate of the duty imposed on imports originating in Malaysia is 213.1%. This definitive anti-dumping duty entered into force on the day of the publication of the resolution in the Federal Official Gazette of Brazil, i.e. on June 22nd, 2015, and is applicable for a period of five years.
