Anti-dumping

On June 13, 2014, the Secretary for Foreign Trade of the Brazilian Ministry of Development, Industry and Foreign Trade decided to initiate an anti-dumping investigation on imports of ferrite magnets from China and South Korea (Circular No. 30, 13.06.2014).
The products subject to investigation are classified under the following HS code: 8505.1910.
The complaint was lodged on April 25, 2014 by Ugimag do Brasil Indústria e Comércio de Produtos Magnéticos Ltda., which is the main domestic producer of the goods under scrutiny with a share of around 98%.
The investigation started on the day of the publication of the circular in the Federal Official Gazette of Brazil, i.e. on June 16, 2014.
 
On September 26, 2014, the Brazilian Ministry of Development, Industry and Foreign Trade made a preliminary determination of dumping against imports of ferrite magnets from China and South Korea (Circular No. 58, 26.09.2014). The investigation continues until the final determination. Circular No. 58 was published in the Federal Official Gazette of Brazil on September 29, 2014.
 
On October 29, 2014, the Brazilian authorities decided to impose a provisional anti-dumping duty on imports of ferrite magnets originating in China and South Korea (Resolution No. 96, 29.10.2014).
The amount of the duty imposed on imports originating in China ranges from USD 599.02 to USD 3,044.34 per metric ton, depending on the company. The amount of the duty imposed on imports originating in South Korea is USD 2,214.90 per metric ton, at the exception of the companies Dong-A Electric Co. Ltd. and Pacific Metals Co. Ltd. whose exports are subject to a duty of USD 190.64 per metric ton (moreover, exports of the company Ssangyong Materials Corporation are not subject to the payment of a duty).
This provisional duty entered into force on the day of the publication of the resolution in the Federal Official Gazette of Brazil, i.e. on October 30, 2014, and is applicable for a period of six months.
 
On April 10, 2015, the Brazilian authorities decided to extend for up to eight months, from April 16, 2015, the investigation period to determine the existence of dumping in exports of ferrite magnets from China and South Korea (Circular No. 23, 10.04.2015). Circular No. 23 was published in the Federal Official Gazette of Brazil on April 13, 2015.
 
On April 29th, 2015, the Brazilian authorities decided to impose a definitive anti-dumping duty on imports of ferrite magnets originating in China and South Korea (Resolução No. 31, 29.04.2015).
The amount of the duty imposed on imports originating in China ranges from USD 1,987.45 to USD 3,382.60 per metric ton, depending on the company. The amount of the duty imposed on imports originating in South Korea is USD 2,461.00 per metric ton, at the exception of the companies Dong-A Electric Co. Ltd. and Pacific Metals Co. Ltd. whose exports are subject to a duty of USD 117.38 per metric ton.
This definitive anti-dumping duty entered into force on May 4th, 2015 and is applicable for a period of five years.
