Anti-dumping

On May 23, 2008, the Indian authorities initiated a second sunset review of the anti-dumping duty imposed on imports of vitamin C (and most commonly used synonyms of vitamin C like ascorbic acid, L-Xyloascorbic acid, 3-Oxo-L-gulofuranolactone (enol form), L-3-Ketothreohexuronic acid lactone, etc.) from China.
The product subject to investigation is classified under the following HS code: 2936.2700.
 
On May 21, 2009, the Indian authorities issued their final findings of the sunset review. They recommended the continuation of the existing anti-dumping measure.
 
On June 16, 2009, the Indian authorities issued the notification of extension of the anti-dumping duty imposed on imports of vitamin C from China (Notification No. 67/2009-Customs, 16.06.2009). The amount of the duty is USD 3.99 per kilogram. This duty is effective for a period of five years.
 
The original anti-dumping duty was decided on May 25, 1998 and imposed by Notification No. 53/98-Customs on July 24, 1998. A first sunset review was already initiated on August 14, 2002 and terminated on July 31, 2003 with the continuation of the duty. The extended duty was imposed by Notification No. 159/2003-Customs on October 24, 2003.
 
On June 11, 2014, the Indian authorities initiated a third sunset review of the anti-dumping duty imposed on imports of vitamin C from China.
This sunset review follows the application lodged by Bajaj Healthcare Limited on behalf of the domestic producers of the good subject to the duty.
 
While initiating the sunset review, the Indian authorities decided on July 23, 2014 to extend upto and inclusive of June 15, 2015 the existing definitive anti-dumping duty imposed on June 16, 2009 by Notification No. 67/2009-Customs (Notification No. 33/2014-Customs (ADD), 23.07.2014).
 
On June 10th, 2015, the Indian Directorate General of anti-dumping & allied duties, Ministry of Commerce & Industry, issued its final findings of the sunset review. It recommended the continuation of the existing anti-dumping measure.
 
On August 6th, 2015, the Indian Ministry of Finance issued the Customs Notification of extension of the anti-dumping duty imposed on imports of vitamin C originating in China (Notification No. 38/2015-Customs (ADD), 06.08.2015). The amount of the duty is USD 3.74 per kilogram. This duty is effective for a period of five years.
