Anti-dumping

On August 30th, 2007, the Indian Directorate General of anti-dumping & allied duties, Ministry of Commerce and Industry, initiated an anti-dumping investigation on imports of compact fluorescent lamps (with or without ballast/control gear/choke, whether or not assembled, either in CKD or SKD conditions) from China, Sri Lanka and Vietnam.
The products subject to investigation are classified under the following HS codes: 8539.31 and 8539.90.
The complaint was lodged by M/s. Indo Asian Fusegear Ltd., M/s. Havell's India Ltd. and M/s. Osram India Pvt. Ltd.
 
On March 12th, 2008, the Indian Directorate General of anti-dumping & allied duties, Ministry of Commerce and Industry, issued its preliminary findings and recommended the imposition of a provisional anti-dumping duty on imports of the above-mentioned goods originating in China and Vietnam.
 
On September 25th, 2008, the Indian authorities extended the time for completing the investigation by three months, i.e. up to November 30th, 2008.
 
On November 21st, 2008, the Indian Ministry of Finance issued the Customs. Notification imposing this provisional anti-dumping duty (Notification No. 126/2008-Customs, 21.11.2008). For details about the amount of the duty, see table of Notification No. 126/2008-Customs.
No duty was imposed on imports originating in Sri Lanka due to a de-minimus volume of imports.
 
On December 1st, 2008, the Indian authorities extended the time for completing the investigation by another three months.
 
On February 27th, 2009, the Indian Directorate General of anti-dumping & allied duties, Ministry of Commerce and Industry, issued its final findings and recommended the imposition of a definitive anti-dumping duty on imports of the above-mentioned goods originating in China and Vietnam.
 
On May 26th, 2009, the Indian Ministry of Finance issued the Customs. Notification imposing this definitive anti-dumping duty (Notification No. 55/2009-Customs, 26.05.2009). For details about the amount of the duty, see table of Notification No. 55/2009-Customs.
This definitive duty is effective from the date of imposition of the provisional anti-dumping duty, i.e. from November 21, 2008.
 
On November 14th, 2013, the Indian Directorate General of anti-dumping & allied duties, Ministry of Commerce & Industry, initiated a sunset review of the anti-dumping duty imposed on imports of compact fluorescent lamps originating in China.
This review follows the application lodged by the Electric Lamp and Component Manufacturers' Association of India.
No sunset review was initiated for imports originating in Vietnam. Hence, the anti-dumping measure imposed on imports originating in Vietnam expired on November 21st, 2013.
 
While initiating the sunset review, the Indian authorities decided on January 3rd, 2014 to extend up to November 20th, 2014 the existing anti-dumping duty imposed on May 26th, 2009 by Notification No. 55/2009-Customs as far as China as trading partner is concerned (Notification No. 02/2014-Customs (ADD), 03.01.2014).
 
On October 20th, 2014, the Indian authorities extended the time for completing the sunset review up to May 13th, 2015.
 
On May 11th, 2015, the Indian Directorate General of anti-dumping & allied duties, Ministry of Commerce & Industry, issued its final findings of the sunset review. It recommended the continuation of the existing anti-dumping measure.
 
On August 12th, 2015, the Indian Ministry of Finance issued the Customs. Notification of extension of the anti-dumping duty imposed on imports of flax fabrics from China and Hong Kong (Notification No. 39/2015-Customs (ADD), 12.08.2015). The amount of the duty is USD 0.302 per piece.
This duty is effective for a period of five years.
