Anti-dumping

On September 8th, 2009, the European Commission announced the initiation of an anti-dumping investigation on imports of high tenacity yarn of polyesters (other than sewing thread), not put up for retail sale, including monofilament of less than 67 decitex, from China, Chinese Taipei and South Korea (Notice No 2009/C 213/08).
The products subject to investigation are classified under the following HS code: 5402.2000. The complaint was lodged on July 27th, 2009 by CIRFS - European Man-made Fibres Association on behalf of companies representing more than 60% of the EU production of the subject goods.

On June 1st, 2010, the European Commission decided to impose a provisional anti-dumping duty on imports of high tenacity yarn of polyesters originating in China (Commission Regulation (EU) No 478/2010). The rate of this duty is 9.3% of the net free-at-Union-frontier price, at the exception of the following companies whose exports are subject to a preferential treatment: Zhejiang Unifull Industrial Fibre Co., Ltd. (7.7%), Zhejiang Hailide New Material Co., Ltd. (0%, i.e. exemption from the measure), Hangzhou Huachun Chemical Fiber Co., Ltd. (8.9%), Heilongjiang Longdi Co., Ltd. (8.9%), Hyosung Chemical Fiber (Jiaxing) Co., Ltd. (8.9%), Oriental Industies (Suzhou) Ltd. (8.9%), Shanghai Wenlong Chemical Fiber Co., Ltd. (8.9%), Shaoxing Haifu Chemistry Fibre Co., Ltd. (8.9%), Sinopec Shanghai Petrochemical Company (8.9%) and Wuxi Taiji Industry Co., Ltd. (8.9%). No provisional duty was imposed on imports originating in Chinese Taipei and South Korea.
This provisional duty entered into force on the day following the publication of the resolution in the Official Journal of the European Union (L 135), i.e. on June 3rd, 2010, and applies for a period of six months.

On November 29th, 2010, the European authorities decided upon the imposition of a definitive anti-dumping duty on imports of high tenacity yarn of polyesters originating in China (Council Implementing Regulation (EU) No 1105/2010, 29.11.2010).
The rate of this duty is 9.8% of the net free-at-Union-frontier price, at the exception of the following companies whose exports are subject to a preferential treatment: Zhejiang Guxiandao Industrial Fibre Co. Ltd. (5.1%), Zhejiang Hailide New Material Co., Ltd. (0%, i.e. exemption from the measure), Zhejiang Unifull Industrial Fibre Co., Ltd. (5.5%), Hangzhou Huachun Chemical Fiber Co. Ltd. (0%, i.e. exemption from the measure), Heilongjiang Longdi Co. Ltd. (5.3%), Hyosung Chemical Fiber (Jiaxing) Co. Ltd. (5.3%), Shanghai Wenlong Chemical Fiber Co. Ltd. (5.3%), Shaoxing Haifu Chemistry Fibre Co. Ltd. (5.3%), Sinopec Shanghai Petrochemical Company (5.3%) and Wuxi Taiji Industry Co. Ltd. (5.3%).
This definitive duty entered into force on the day following the publication of the resolution in the Official Journal of the European Union (L 315), i.e. on December 2nd, 2010.
With Council Implementing Regulation (EU) No 1105/2010 the European authorities also decided upon the termination of the investigation without imposing any measure as far as Chinese Taipei and South Korea as exporting countries are concerned.

On November 28th, 2015, the European Commission announced the initiation of a sunset review of the anti-dumping duty imposed on imports of high tenacity yarn of polyesters originating in China (Notice No 2015/C 397/05). This sunset review follows the application lodged on August 31st, 2015 by CIRFS - The European Manmade Fibres Association on behalf of producers representing more than 25% of the EU production of the subject goods.
 
On 26 February 2017, the European Commission extended the definitive anti-dumping duty on imports of subject good from China following the conclusion of the above sunset review (Commission Implementing Regulation (EU) 2017/272). The rate of duty is between 5.1% and 9.8% of the net free-at-Union-frontier price before duty depending on the company in question. This is with the exception of the companies Zhejiang Hailide New Material Co. Ltd and Hangzhou Huachun Chemical Fiber Co. Ltd which are exempt from anti-dumping duties.
