Anti-dumping

On August 20th, 2009, the Indian Directorate General of Anti-dumping & Allied Duties, Ministry of Commerce and Industry, initiated a sunset review of the anti-dumping duty imposed on imports of narrow woven fabric having pile weave, made up of man-made fibres, used as a fastening tape, from China and Chinese Taipei. The products subject to investigation are classified under the following HS code subheading: 5806.10.
 
While initiating the sunset review, the Indian authorities decided on April 12th, 2010 to extend up to February 13th, 2011 the existing definitive anti-dumping duty imposed on July 25th, 2005 by Notification No. 76/2005-Customs (Notification No. 46/2010-Customs, 12.04.2010).
 
On August 19th, 2010, the Indian Directorate General of Anti-dumping & Allied Duties, Ministry of Commerce & Industry, issued its final findings of the sunset review. It recommended the continuation, with modifications, of the existing anti-dumping measure.
 
On October 6th, 2010, the Indian Ministry of Finance issued the Customs Notification of extension of the anti-dumping duty imposed on imports of narrow woven fabric from China and Chinese Taipei (Notification No. 108/2010-Customs, 06.10.2010). The amount of the duty imposed on imports originating in China is USD 2.87 per kilogram. The amount of the duty imposed on imports originating in Chinese Taipei is USD 1.75 per kilogram. This duty is effective for a period of five years.
 
On October 1st, 2015, the Indian Directorate General of Anti-dumping & Allied Duties, Ministry of Commerce and Industry, initiated a second sunset review of the anti-dumping duty imposed on imports of narrow woven fabric from China and Chinese Taipei.
It follows the application lodged by M/s. Ishi Industries Limited, a domestic producer of the subject goods.
 
While initiating the sunset review, the Indian authorities decided on October 28th, 2015 to extend up to October 5th, 2016 the existing definitive anti-dumping duty imposed on October 6th, 2010 by Notification No. 108/2010-Customs (Notification No. 52/2015-Customs (ADD), 28.10.2015).
 
On 6 October 2016, following the conclusion the above-mentioned sunset review the Indian Ministry of Finance, Department of Revenue extended the definitive anti-dumping duty (Notification No. 50/2016-Customs (ADD)). The amount of duty imposed on imports originating in or exported from China is USD 1.87 per kilogram. No duty was imposed on imports of the subject good from Chinese Taipei, thus the duty expired. This definitive duty is in force for a period of five years.
