Anti-dumping

On March 19th, 2014, the Ministry of Commerce of the People's Republic of China decided to initiate an anti-dumping investigation on imports of optical fiber preform from Japan and the United States of America (MOFCOM Announcement No. 17 of 2014, 19.03.2014).
The products subject to investigation are classified under the following HS code: 7002.2010.
The complaint was lodged on January 22nd, 2014 by Yangtze Optical Fibre and Cable Company Ltd., Jiangsu Hengtong Photoelectric Stock., Ltd. and Futong Group Co., Ltd.
 
On March 6th, 2015, the the Ministry of Commerce of the People's Republic of China decided to extend the investigation period for up to five months, i.e. until August 19th, 2015, the investigation period to determine the existence of dumping in exports of optical fiber preform from Japan and the United States of America (MOFCOM Announcement No. 8 of 2015, 06.03.2015).
 
On May 18th, 2015, the Ministry of Commerce of the People's Republic of China decided to impose a provisional anti-dumping duty on imports of optical fibre preform from Japan and the United States of America (MOFCOM Announcement No. 15 of 2015, 18.05.2015).
The rate of the duty imposed on imports originating in Japan is 8.9%, at the exception of the following companies whose exports are subject to a special rate: Sumitomo Electric Industries, Ltd. (7.8%), Fujikura Ltd. (8.3%) and Furukawa Electric Co., Ltd. (8.3%). The rate of the duty imposed on imports originating in the United States of America is 39%, at the exception of the company OFS Fitel, LLC. whose exports are subject to a duty of 16.9%.
This provisional measure entered into force on May 22nd, 2015.
 
On August 19th, 2015, the Ministry of Commerce of the People's Republic of China decided to impose a definitive anti-dumping duty on imports of optical fibre preform from Japan and the United States of America (MOFCOM Announcement No. 25 of 2015, 19.08.2015).
The rate of the duty imposed on imports originating in Japan is 9.1%, at the exception of the following companies whose exports are subject to a special rate: Shin-Etsu Chemical Co., Ltd. (8.0%), Fujikura Ltd. (8.5%) and Furukawa Electric Co., Ltd. (8.5%). The rate of the duty imposed on imports originating in the United States of America is 41.7%, at the exception of the company OFS Fitel, LLC. whose exports are subject to a duty of 17.4%.
This definitive duty entered into force on August 19th, 2015 and is applicable for a period of two years.

On 19 August 2017, the Ministry of Commerce of the People's Republic of China initiated a sunset review of the anti-dumping duty imposed on imports of the subject good from the United States and Japan (MOFCOM Announcement No. 35 of 2017). It follows the application lodged on 8 June 2017 by Yangtze Optical Fibre and Cable Joint Stock Limited Company, Jiangsu Hengtong Optical Fiber Technology Co., Ltd and FUTONG Group Co., Ltd. The existing anti-dumping duty remains in force during the review period.

On 11 July 2018, the Chinese authorities extended the definitive duty imposed on imports of optical fiber preform from the United States and Japan following the conclusion of the sunset review. The rate of duty is continued and is in force from 11 July 2018 for a period of five years.
