Anti-dumping

On March 31, 2009, the Indian authorities initiated a sunset review of the anti-dumping duty imposed on imports of PVC past resin from the European Union.
The products subject to investigation are classified under the following HS code: 3904.
On April 26, 2010, the Indian authorities issued their final findings of the sunset review. They recommended the continuation of the existing anti-dumping measure. On June 25, 2010, the Indian authorities issued the notification of extension of the anti-dumping duty imposed on imports of PVC past resin from the European Union (Notification No. 70/2010-Customs, 25.06.2010). The amount of the duty is USD 267.38 per metric ton. This duty is effective for a period of five years.
After Leather Cloth and Plastics Manufacturers Association (LCMPA) filed an appeal before CESTAT, challenging the continued imposition of anti-dumping duty on imports of PVC past resin from the European Union according to Notification No. 70/2010-Customs dated June 25, 2010, the Indian authorities reconsidered the case. They issued the final findings of this second investigation on April 4, 2013, still recommending the imposition of an anti-dumping duty on imports of PVC past resin from the European Union. On July 3, 2013, the Indian authorities issued the notification of extension of the anti-dumping duty imposed on imports of PVC past resin from the European Union following the re-investigation requested by Leather Cloth and Plastics Manufacturers Association (LCMPA) (Notification No. 15/2013-Customs (ADD), 03.07.2013). The amount of the modified duty is USD 265.19 per metric ton. This duty is effective upto and inclusive of June 24, 2015.

On April 27th, 2015, the Indian Directorate General of anti-dumping & allied duties, Ministry of Commerce & Industry, initiated a second sunset review of the anti-dumping duty imposed on imports of PVC past resin from the European Union as well as from China, Chinese Taipei, Japan, Malaysia, Russia, South Korea and Thailand (see measure 0893).
While initiating the sunset review, the Indian authorities decided on June 1st, 2015 to extend up to June 24th, 2016 the existing definitive anti-dumping duty imposed on June 25th, 2010 by Notification No. 70/2010-Customs (Notification No. 26/2015-Customs (ADD), 01.06.2015).
 
On 23 June 2016, following the conclusion the above-mentioned sunset review the Indian Ministry of Finance issued the Customs Notification extending the definitive anti-dumping duty (Notification No. 27/2016-Customs (ADD), 23.06.2016). The amount of the duty imposed on imports originating in or exported from the European Union is USD 298 per metric ton. This definitive duty is effective for a period of five years. The Customs Notification additionally extended the anti-dumping duty on import of the subject good from China, Chinese Taipei, Japan, Malaysia, Russia, the Republic of Korea and Thailand, see related measure.
