Anti-dumping

On June 21, 2013, the South African authorities initiated an anti-dumping investigation on imports of frozen potato chips from Belgium and the Netherlands.
The products subject to investigation are classified under the following HS code: 2004.1090.
On December 20, 2013, the South African authorities imposed a provisional anti-dumping duty on imports of frozen potato chips from Belgium and the Netherlands. The rate of the duty is 30.77% for imports originating in Belgium, at the exception of the company Clarebout Potatoes whose exports are subject to a duty of 6.19%, and 18.18% for imports originating in the Netherlands.
According to the WTO semi-annual report of anti-dumping actions taken by South Africa, the investigation was completed on August 8, 2014. However, as of December 31, 2014, no definitive duty has been imposed yet.

On 21 October 2016, the South African Revenue Service imposed a definitive antidumping duty on imports of the subject good from Belgium and the Netherlands. The rate of duty on imports from Belgium is between 6.19% and 30.77% depending on the company. The rate of duty on import from the Netherlands is 12.52% or 16.42% depending on the company.

On 26 July 2019, the Internation Trade Administration Commission of South Africa initiated a sunset review of the definitive antidumping duty imposed on imports of potato chips from Belgium and the Netherlands. This follows the application lodged by McCain Foods SA (Pty) Ltd.
