In May 2013, the government of India initiated a new anti-dumping investigation. In May 2014, a provisional duty was imposed and a definitive duty was then imposed in September 2014. In May 2019, the definitive duty was terminated.

Anti-dumping

On May 7, 2013, the Indian Directorate General of anti-dumping & allied duties, Ministry of Commerce, initiated an anti-dumping investigation on imports of phenol from Chinese Taipei and the United States of America. The product subject to investigation is classified under the following HS code: 2907.1110. This follows the application lodged by M/s Hindustan Organic Chemicals Limited, one of the two domestic producers of the investigated good.

On March 5, 2014, the Indian Directorate General of anti-dumping & allied duties, Ministry of Commerce, issued its preliminary findings and recommended the imposition of a provisional anti-dumping duty on imports of phenol from Chinese Taipei and the United States of America.

On May 16, 2014, the Indian Ministry of Finance issued the Customs Notification imposing a provisional anti-dumping duty on imports of phenol originating in Chinese Taipei and the United States of America (Notification No.23 /2014-Customs (ADD), 16.05.2014). The amount of the duty imposed on imports originating in Chinese Taipei ranges from USD 46.07 to USD 193.9 per metric ton, depending on the exporter/producer. The amount of the duty imposed on imports originating in the United States of America is USD 146.09 per metric ton. This duty shall remain into force for a period of six months.

On May 29, 2014, the Indian authorities extended the time for completing the investigation up to August 6, 2014.

On August 6, 2014, the Indian Directorate General of anti-dumping & allied duties, Ministry of Commerce, issued its final findings and recommended the imposition of a definitiveanti-dumping duty on imports of phenol from Chinese Taipei and the United States of America.

On September 30, 2014, the Indian Ministry of Finance issued the Customs Notification imposing a definitive anti-dumping duty on imports of phenol originating in Chinese Taipei and the United States of America (Notification No. 43/2014-Customs (ADD), 30.09.2014). The amount of the duty imposed on imports originating in Chinese Taipei is USD 196.24 per metric ton, at the exception of the companies Taiwan Prosperity Chemical Corporation and Formosa Chemicals & Fibre Corporation whose exports are subject to a duty of USD 47.29 per metric ton and USD 78.97 per metric ton respectively. The amount of the duty imposed on imports originating in the United States of America is USD 159.63 per metric ton. This definitive anti-dumping duty shall be levied for a period of five years with effect from the date of imposition of the provisional anti-dumping duty, that is, May 16, 2014.

On 15 May 2019, the Indian authorities terminated the definitive duty imposed on imports of peroxosulphates from phenol from Chinese Taipei and the United States of America. The duty was terminated as it was set to expire.
