Anti-dumping

On October 8, 2013, the Indian authorities initiated an anti-dumping investigation on imports of purified terephthalic acid (including its variants medium quality terephthalicacid (MTA) and qualified terephthalic acid (QTA)) from China, the European Union, South Korea and Thailand.
The product subject to investigation is classified under the following HS code: 2917.3600.
The complaint was lodged by M/s MCC PTA India Corp. Pvt. Ltd and M/s Reliance Industries Limited on behalf of the domestic industry.
According to the UN Comtrade Database, in 2013 the following EU member exported purified terephthalic acid to India with a trade value over USD 1 million: Poland (USD 7.83 million).
 
On June 19, 2014, the Indian authorities issued their preliminary findings. They recommended the imposition of a provisional anti-dumping duty on imports of terephthalic acid from China, the European Union, South Korea and Thailand.
This provisional duty was imposed on July 25, 2014 (Notification No. 36/2014-Customs (ADD), 25.07.2014). The amount of the duty imposed on imports originating in China is USD 62.82 per metric ton. The amount of the duty imposed on imports originating in South Korea is USD 117.09 per metric ton, at the exception of the companies Samsung General Chemical Co. Ltd. and Taekwang Industrial Co. Ltd. whose exports are subject to a duty of USD 29.86 per metric ton and USD 19.05 per metric ton respectively. The amount of the duty imposed on imports originating in Thailand is USD 99.51 per metric ton, at the exception of the companies Indorama Petrochem Ltd. and TPT Petrochemicals Public Limited whose exports are subject to a duty of USD 27.49 per metric ton. The amount of the duty imposed on imports originating in the European Union is USD 23.75 per metric ton. This provisional duty is effective for a period not exceeding six months.
 
On October 15th, 2014, the Indian authorities extended the time for completing the investigation up to April 7th, 2015.
 
On April 7th, 2015, the Indian Directorate General of anti-dumping & allied duties, Ministry of Commerce and Industry, issued its final findings and recommended the imposition of a definitive anti-dumping duty on imports of purified terephthalic acid from South Korea and Thailand. The investigation concerning imports from China and the European Union was terminated due to a volume of imports that is below the de minimis level.
 
On May 27th, 2015, the Indian Ministry of Finance issued the Customs Notification imposing this definitive anti-dumping duty (Notification No. 23/2015-Customs (ADD), 27.05.2015). The amount of the duty imposed on imports originating in South Korea is USD 78.28 per metric ton, at the exception of the companies Samsung General Chemical Co. Ltd. and Taekwang Industrial Co. Ltd. whose exports are subject to a duty of USD 27.32 per metric ton and USD 23.61 per metric ton respectively. The amount of the duty imposed on imports originating in Thailand is USD 62.55 per metric ton, at the exception of the companies Indorama Petrochem Ltd. and TPT Petrochemicals Public Limited whose exports are subject to a duty of USD 45.43 per metric ton.
This definitive duty is effective for a period of five years from the date of imposition of the provisional anti-dumping duty, i.e. from July 25th, 2014.
