Anti-dumping

On March 1, 2010, the Peruvian authorities decided, after having conducted an expiry review, to continue the anti-dumping duty on imports of poplin fabrics (unbleached, bleached, dyed or printed plain weave fabrics, or plain weave fabrics of yarns of different colours), at least 2.20 meters wide, weighing between 50 and 250 g/m2, of polyester-cotton blend (mixtures of any composition) from Pakistan (Resolution No. 031-2010/CFD-INDECOPI, 01.03.2010).
The products subject to the duty are classified under the following HS codes: 5210.1100, 5210.2100, 5210.3100, 5210.4100, 5210.5100, 5211.1100, 5211.2100, 5211.3100, 5211.4100, 5211.5100, 5513.1100, 5513.2100, 5513.3100, 5513.4100, 5513.5100, 5514.1100, 5514.2100, 5514.3100, 5514.4100 and 5514.5100. The amount of the duty is USD 0.67 per kilogram.
This definitive anti-dumping duty entered into force on the day following the publication of the resolution in the Official Journal El Peruano, i.e. on March 15, 2010, and is applicable for a period of five years.
This duty follows an expiry review requested on February 6, 2009 by Perú Pima. A review was then initiated by the Peruvian National Institute of Antitrust and Intellectual Property Protection (Indecopi) on March 2, 2009 (Resolution No. 034-2009/CFD-INDECOPI, 02.03.2009). The review started on the day of the publication of the resolution in the Official Journal El Peruano, i.e. on March 5, 2009.
 
The original anti-dumping duty imposed on certain types of poplin fabrics of polyester-cotton blend from Pakistan was decided on February 26, 2004 (Resolution No. 017-2004/CDS-INDECOPI, 26.02.2004) and entered into force on the day following the publication of the resolution in the Official Journal El Peruano, i.e. on March 7, 2004.
 
On December 12, 2014, the Peruvian authorities decided to initiate a sunset review of the anti-dumping duty imposed on March 1, 2010 by Resolution No. 031-2010/CFD-INDECOPI (Resolution No. 136-2014/CFD-INDECOPI, 12.12.2014). This follows the request lodged on July 14, 2014 by Perú Pima S.A. The review started on the day of the publication of the resolution in the Official Journal El Peruano, i.e. on December 24, 2014. The existing anti-dumping duty remains in force during the review.
 
On March 30, 2015, the Peruvian authorities decided to initiate an ex officio review for change of circumstances since the original imposition of the above-mentioned anti-dumping measure in 2004 and its first subsequent extension in 2010 (Resolution No. 047-2015/CFD-INDECOPI, 30.03.2015).
 
On 12 April 2016, the Peruvian authorities extended the above duty on certain poplin fabrics from Pakistan. The duty is in force for a period of five years from 15 March 2015 (Resolution No. 104-2016 / CDB-INDECOPI, 22.06.2016).
 
On 12 October 2016, the Peruvian authorities amended the definitive duty imposed on imports of the subject good from Pakistan. The rate of duty is amended to USD 0.63 per kilogram.
