In August 2009, the government of Peru initiated a new anti-subsidy investigation and imposed a provisional duty in December 2009. In August 2010, a definitive duty was imposed. In August 2015, a sunset review was initiated and the definitive duty was extended for a new period in January 2017. In February 2020, a sunset review was intiaited.

Anti-subsidy

On August 21, 2009, the Peruvian National Institute of Antitrust and Intellectual Property Protection (Indecopi) decided to initiate an anti-subsidy investigation on imports of pure biodiesel (B100) and mixtures containing more than 50% biodiesel (B50) from the United States of America (Resolution No. 140-2009/CFD-INDECOPI, 21.08.2009). The products subject to investigation are classified under the following HS code subheading: 3824.90.99.99. The complaint was lodged on March 26, 2009 by Industrias del Espino S.A. The investigation started on the day of the publication of the resolution in the Official Journal El Peruano, i.e. on August 26, 2009.

On December 17, 2009, the Peruvian authorities decided to impose a provisional countervailing duty on imports of biodiesel from the United States of America (Resolution No. 201-2009/CFD-INDECOPI, 17.12.2009). The amount of this provisional duty is USD 178 per metric ton. This provisional countervailing duty entered into force on the day following the publication of the resolution in the Official Journal El Peruano, i.e. on December 24, 2009, and is applicable for a period of six months.

On August 17, 2010, the Peruvian authorities decided to impose a definitive countervailing duty on imports of pure biodiesel (B100) and mixtures containing more than 50% biodiesel from the United States of America (Resolution No. 151-2010/CFD-INDECOPI, 17.08.2010). The amount of the definitive duty is USD 178 per metric ton. This definitive countervailing duty entered into force on the day following the publication of the resolution in the Official Journal El Peruano, i.e. on August 23, 2010.

On August 14th, 2015, the Peruvian authorities decided to initiate a sunset review of the countervailing duty imposed on imports of biodiesel from the United States of America by Resolution No. 151-2010/CFD-INDECOPI dated August 17th, 2010 (Resolution No. 110-2015/CFD-INDECOPI, 14.08.2015).
This follows the request lodged on May 20th, 2015 by Industrias del Espino S.A. The review started on the day of the publication of the resolution in the Official Journal El Peruano, i.e. on August 21st, 2015.
The existing countervailing duty remains in force during the review.

On 28 January 2017, the Peruvian authorities extended the countervailing duty imposed on imports of the subject good from the United States. The rate of duty remains at USD 178 per tonne. The measure is in force from 23 August 2015 for a period of five years.

On 13 February 2020, the Peruvian authorities initiated a sunset review of the definitive duty imposed on the subject good from the United States.
