In October 2010, the government of Peru initiated a sunset review of the antidumping duty imposed on stainless steel cutlery from China. The definitive antidumping duty was extended in July 2011 and June 2017.

Anti-dumping

On July 6, 2011, the Peruvian authorities decided, after having conducted a review, to continue the anti-dumping duty on imports of stainless steel cutlery (with thickness not exceeding 1.25 mm) from China (Resolution No. 082-2011/CFD-INDECOPI, 06.07.2011).

The products subject to the duty are classified under the following HS codes: 8215.1000 and 8215.9900. The amount of the duty is USD 1.64 per kilogram. This definitive anti-dumping duty entered into force on the day following the publication of the resolution in the Official Journal El Peruano, i.e. on July 18, 2011, and is applicable for a period of five years.

This duty follows an ex officio review to changed circumstances decided on October 5, 2010 by the Peruvian Supervisory Commission on Dumping and Subsidies of the Indecopi itself (Resolution No. 175-2010/CFD-INDECOPI, 05.10.2010). The review started on the day of the publication of the resolution in the Official Journal El Peruano, i.e. on October 14, 2010.

The original anti-dumping duty imposed on stainless steel cutlery from China was decided on February 7, 2002 (Resolution No. 004-2002/CDS-INDECOPI, 07.02.2002) and entered into force on the day of the second publication of the resolution in the Official Journal El Peruano, i.e. on February 19, 2002.
 
On 6 July 2016, the Peruvian authorities decided to initiate a sunset review of the anti-dumping duty imposed on above goods from China (Resolution No. 117-2016/CFD-INDECOPI, 06.07.2016). This follows the request lodged on 17 November 2015 by Fábrica de Cubiertos S.A.C. - FACUSA. The review started on the day of the publication of the resolution in the Official Journal El Peruano, i.e. on 15 July 2016. The existing anti-dumping duty remains in force during the review.

On 12 June 2017, the Peruvian authorities extended the antidumping duty imposed on imports of the subject good from China for a period of five years from 19 July 2016. The rate of duty is USD 1.64 per kilogram on goods with a FOB price lower than USD 18.4 per kilogram.
