Anti-dumping

On February 23, 2009, the Peruvian authorities decided, after having conducted an expiry review, to continue the anti-dumping duty on imports of paperboard cups with polyethylene from Chile and produced by B.O. Foodservice S.A. and B.O. Packaging S.A. (Resolution No. 030-2009/CFD-INDECOPI, 23.02.2009).
 
The products subject to the duty are classified under the following HS code: 4823.6000. The amount of the duty is the difference between the importation CIF price declared and the reference CIF price set at 3.50 USD per kilogram. The duty is due only if the importation CIF price declared is lower than this reference CIF price. This definitive anti-dumping duty entered into force on the day following the publication of the resolution in the Official Journal El Peruano, i.e. on March 14, 2009, and is applicable for a period of three years.
 
This duty follows an expiry review requested on August 7, 2007 by Perú Cups S.A. A review was then initiated by the Peruvian National Institute of Antitrust and Intellectual Property Protection (Indecopi) on September 20, 2007 (Resolution No. 099-2007/CDS-INDECOPI, 20.09.2007). The review started on the day of the publication of the resolution in the Official Journal El Peruano, i.e. on September 24, 2007.
 
The original anti-dumping duty imposed on paperboard cups with polyethylene from Chile was decided on September 12, 2002 (Resolution No. 052-2002/CDS-INDECOPI, 12.09.2002) and entered into force on the day following the publication of the resolution in the Official Journal El Peruano, i.e. on September 26, 2002.
 
On February 23, 2012, the Peruvian authorities decided to remove the anti-dumping duty imposed on imports of paperboard cups with polyethylene from Chile (Resolution No. 021-2012/CFD-INDECOPI, 23.02.2012). This decision entered into force on March 15, 2012. This resolution was published in the Official Journal El Peruano on March 4, 2012.
