Anti-dumping

On February 6, 2009, the Peruvian authorities decided, after having conducted an expiry review, to continue the anti-dumping duty on imports of refined vegetable oils from soybean, sunflower and mixtures thereof from Argentina and produced by Molinos Río de la Plata S.A., Aceitera General Deheza S.A., Nidera S.A. and Aceitera Martínez S.A. (Resolution No. 021-2009/CFD-INDECOPI, 06.02.2009).

The products subject to the duty are classified under the following HS codes: 1507.1000, 1507.9000, 1512.1100 and 1512.1900. The amount of the duty is USD 73 per metric ton. This definitive anti-dumping duty entered into force on the day of the publication of the resolution in the Official Journal El Peruano, i.e. on February 15, 2009, and is applicable for a period of three years.

This duty follows an expiry review requested on August 28, 2007 by Industrias del Espino S.A. as well as by the National Society of Industries (Sociedad Nacional de Industrias) on behalf UCISA S.A., Industrial Alpamayo S.A. and Alicorp S.A.A. A review was then initiated by the Peruvian National Institute of Antitrust and Intellectual Property Protection (Indecopi) on November 22, 2007 (Resolution No. 119-2007/CDS-INDECOPI, 22.11.2007). The review started on the day of the publication of the resolution in the Official Journal El Peruano, i.e. on November 28, 2007.

The original anti-dumping duty imposed on refined vegetable oils from soybean, sunflower and mixtures thereof from Argentina was decided on November 26, 2002 (Resolution No. 062-2002/CDS-INDECOPI, 26.11.2002) and entered into force on the day following the publication of the resolution in the Official Journal El Peruano, i.e. on December 1, 2002.

On February 2, 2012, the Peruvian authorities decided to remove the anti-dumping duty imposed on imports of refined vegetable oils from soybean, sunflower and mixtures thereof from Argentina (Resolution No. 015-2012/CFD-INDECOPI, 02.02.2012). This decision entered into force on February 16, 2012. This resolution was published in the Official Journal El Peruano on February 13, 2012.
