Anti-dumping

On June 16, 2011, the Colombian authorities decided, after having conducted an expiry review, to continue the anti-dumping duty on imports of crockery and loose pieces of porcelain and earthenware from China (Resolution 0342, 16.06.2011).
The products subject to the duty are classified under the following HS codes: 6912.0000 and 6911.1000.
The amount of the duty for crockery and loose pieces of earthenware (HS code 6912.0000) is the difference between the FOB declared by the importer and the reference FOB set at 1.71 USD per kilogram. The duty is due only if the FOB declared by the importer is lower than this reference FOB. The amount of the duty for crockery and loose pieces of porcelain (HS code 6911.1000) is the difference between the FOB declared by the importer and the reference FOB set at 2.88 USD per kilogram. The duty is due only if the FOB declared by the importer is lower than this reference FOB.
This definitive anti-dumping duty entered into force on the day of the publication of the resolution in the Official Journal of the Republic of Colombia, i.e. on June 20, 2011, and is applicable for a period of three years.
This duty follows an expiry review requested on July 14, 2010 by Locería Colombiana S.A. A review was then initiated by the Colombian Ministry of Commerce, Industry and Tourism on September 17, 2010 (Resolution 429, 17.09.2010). The review started on the day of the publication of the resolution in the Official Journal of the Republic of Colombia, i.e. on September 22, 2010.

The original anti-dumping duty on crockery and loose pieces of earthenware was decided on November 19, 2004 (Resolution 2647, 19.11.2004). The original anti-dumping duty on crockery and loose pieces of porcelain was decided on December 19, 2005 (Resolution 3052, 19.12.2005). Those duties were then both modified on October 27, 2006 (Resolution 2460, 27.10.2006). Those modified duties entered into force on the day of the publication of the resolution in the Official Journal of the Republic of Colombia, i.e. on November 17, 2006, and were applicable for a period of four years.

On May 5, 2014 the Colombian Ministry of Commerce, Industry and Tourism decided to initiate a sunset review of the definitive anti-dumping duty imposed on June 16, 2011 by Resolution 342 (Resolution 082, 05.05.2014). The existing anti-dumping duty remains in force during the review. Resolution 082 was published in the Official Journal of the Republic of Colombia on May 8, 2014.

On March 19th, 2015, the Colombian authorities terminated the sunset review and decided upon the continuation of the antidumpind duty imposed on imports of crockery and loose pieces of porcelain and earthenware originating in China (Resolution 048, 19.03.2015). The anti-dumping measure imposed on June 16th, 2011 is not modified. The amount of the duty imposed on imports of crockery and loose pieces of earthenware (HS code 6912.0000) is the difference between the FOB declared by the importer and the reference FOB set at USD 1.71 per kilogram. The amount of the duty imposed on imports of crockery and loose pieces of porcelain (HS code 6911.1000) is the difference between the FOB declared by the importer and the reference FOB set at USD 2.88 per kilogram.
This definitive anti-dumping duty entered into force on the day of the publication of the resolution in the Official Journal of the Republic of Colombia, i.e. on March 20th 2015, and is applicable for a period of two years.

On 21 December 2016, the Colombian authorities initiated a sunset review of the antidumping duty imposed on imports of the subject good from China. This follows the application lodged by Locería Colombiana S.A.S. The definitive anti-dumping duty remains in force during the period of review.

On 21 December 2017, the Colombian authorities extended the definitive antidumping duty imposed on imports of crockery and loose pieces of porcelain and earthenware from China following the conclusion of a sunset review. The rate of duty remains unaltered. The rate of duty on imports of crockery and loose pieces of earthenware (HS code 6912.0000) is the difference between the FOB declared by the importer and the reference FOB set at USD 1.71 per kilogram. The rate of the duty on imports of crockery and loose pieces of porcelain (HS code 6911.1000) is the difference between the FOB declared by the importer and the reference FOB set at USD 2.88 per kilogram. The duty is in force for a period of three years.
