Anti-dumping

On September 2, 2008, the Colombian Ministry of Commerce, Industry and Tourism decided to initiate an anti-dumping investigation on imports of shovels, hoes, bars and pickaxes from China (Resolution 0380, 02.09.2008).
 
The products subject to investigation are classified under the following HS codes: 8201.1000 and 8201.3000. The complaint was lodged on June 6, 2008 by the Metal Industry Chamber of the National Business Association of Colombia (Cámara de Fedemetal de la Asociación Nacional de Empresarios de Colombia) and by Herramientas Agrícolas S. A. on behalf of the Colombian domestic industry. The investigation started on the day of the publication of the resolution in the Official Journal of the Republic of Colombia, i.e. on September 4, 2008.
 
On November 6, 2008, the Colombian Ministry of Commerce, Industry and Tourism decided to extend up to December 10, 2008 the investigation period before deciding whether to implement a provisional anti-dumping duty or not (Resolution 0499, 06.11.2008).
 
On December 10, 2008, the Colombian authorities decided to impose a provisional anti-dumping duty on imports of hoes, bars and pickaxes from China (Resolution 0598, 10.12.2008). The amount of the provisional duty is the difference between the FOB declared by the importer and the reference FOB set at 1.41 USD per kilogram. The duty is due only if the FOB declared by the importer is lower than this reference FOB. This provisional anti-dumping duty entered into force on the day of the publication of the resolution in the Official Journal of the Republic of Colombia, i.e. on December 18, 2008. No provisional duty was imposed on imports of shovels (HS code 8201.1000).
 
On February 18, 2009, the Colombian Ministry of Commerce, Industry and Tourism decided to extend up to April 12, 2009 the investigation period before having to present the final results of the investigation (Resolution 0032, 18.02.2009).
 
On March 13, 2009, the Colombian Ministry of Commerce, Industry and Tourism modified the Resolution 0032 (18.02.2009) above-mentioned to extend up to April 20, 2009 instead of April 12, 2009 the investigation period before having to present the final results of the investigation (Resolution 0083, 13.03.2009).
 
On June 18, 2009, the Colombian authorities decided to impose a definitive anti-dumping duty on imports of hoes, bars and pickaxes from China (Resolution 1665, 18.06.2009). The amount of the definitive duty is the difference between the FOB declared by the importer and the reference FOB set at 1.32 USD per kilogram. The duty is due only if the FOB declared by the importer is lower than this reference FOB. This definitive anti-dumping duty entered into force on the day of the publication of the resolution in the Official Journal of the Republic of Colombia and is applicable for a period of five years. No definitive duty was imposed on imports of shovels (HS code 8201.1000).
 
On July 10, 2014 the Colombian Ministry of Commerce, Industry and Tourism decided to initiate a sunset review of the definitive anti-dumping duty imposed on June 18, 2009 by Resolution 1665 (Resolution 135, 10.07.2014). The existing anti-dumping duty remains in force during the review. Resolution 135 was published in the Official Journal of the Republic of Colombia on July 14, 2014.
