Anti-dumping

On January 16, 2014, the Colombian Ministry of Commerce, Industry and Tourism decided to initiate an anti-dumping investigation on imports of plasticizer DOP (diethylhexyl phthalate) from Mexico and South Korea (Resolution 005, 16.01.2014).
The product subject to investigation is classified under the following HS code: 2917.3200. The complaint was lodged on September 30, 2013 by Carboquimica S.A.S. on behalf of the national industry.
The investigation started on the day of the publication of the resolution in the Official Journal of the Republic of Colombia, i.e. on January 20, 2014.

On March 21, 2014, the Colombian Ministry of Commerce, Industry and Tourism decided to continue the investigation without imposing a provisional anti-dumping duty on imports of plasticizer DOP originating in Mexico and South Korea (Resolution 051, 21.03.2014). Resolution 051 was published in the Official Journal of the Republic of Colombia on March 26, 2014.

On August 20, 2014, the Colombian Ministry of Commerce, Industry and Tourism decided to impose a definitive anti-dumping duty on imports of plasticizer DOP originating in Mexico (Resolution 173, 20.08.2014). The amount of the duty is the difference between the FOB price declared by the importer and the reference FOB price set at 1.96 USD per kilogram. This definitive anti-dumping duty entered into force on the day of the publication of the resolution in the Official Journal of the Republic of Colombia, i.e. on August 25, 2014, and is applicable for a period of three years. No anti-dumping duty was imposed on imports originating in South Korea; thus the investigation terminated.

On April 17th, 2015, the Colombian Ministry of Commerce, Industry and Tourism decided to initiate an ex officio review to determine, according to the current circumstances, whether or not to the termination of the investigation without imposition of any anti-dumping measure concerning South Korea remains justified (Resolution 063, 17.04.2015). The review started on the day of the publication of the resolution in the Official Journal of the Republic of Colombia, i.e. on April 21st, 2015.
 
On 4 December 2015, the Colombian Ministry of Commerce, Industry and Tourism imposed definitive anti-dumping duties on imports of plasticizer DOP originating in the Republic of Korea following the above ex officio review. The amount of duty is the difference between the FOB price declared by the importer and the reference FOB price set at USD 1.44 per kilogram. The duty shall remain in force from the day of publication i.e. 9 December 2015 to 20 August 2017.

On 26 September 2017, the Colombian authorities initiated a sunset review of the antidumping duty imposed on imports of the subject good from Mexico and the Republic of Korea. This follows the application lodged by CARBOQUIMICA S.A.S. The definitive anti-dumping duty remains in force during the period of review.
